Peyote legitimacy and legal issues?

I don't know if this is the right place to ask but some one I selling a peyote plant on eBay first question is is this legal? It is a live plant about 5.5 cm across. Second question is is it real he posted 3 pics I screen shot one. http:// Yea but my main question was was it real cause I'm gonna hop on it if it is it's only like 8 bucks. But if it's illegal I might just say forget!

That's a real Peyote. It might not be L. williamsii though. Could be one of the other species, I can't be sure.
As for legality, it all depends on the country you live in and the location of the seller. They're illegal to sell, buy or own in the US. Legal in the EU and most states of Australia, as well as other places. You're not specific so it's hard to say.

The us varies a lot state to state though.
I live in Oregon which is one of the chiller states for sacred cacti and have ordered several from other countries and received them all 
I have seen at least 1 for sale at a local "nursery" too but it was really someones yard and it was just one unlabeled and had an "already sold" mark on it.

Tossing my coin to Diffusa too, 8 bucks is definitely a good price, but if it's an auction on ebay, don't expect to buy at the starting price.
