I doubt this is murder, because I don't believe the gun was fired intentionally at the man's head, but it almost certainly is manslaughter.

with all the surveillance capabilities police have at their fingertips they really shouldn't have to resort to any chases. i'm unsure if it should be banned altogether, but it should be avoided when better means to apprehend dangerous criminals are available.
a good strategy i read about one police chief using in a book i recently read was, instead of a no knock warrant that put everyone's life in danger, they would wait until the person they wanted went out to their car and pounced on them right when they got in and were getting ready to leave. 100% success rate if i recall correctly. maybe if they find people during traffic stops they could hang back and have them followed and get them in a similar way.
