Cops - indecent exposure
#22000194 - 07/26/15 02:28 PM (8 years, 6 months ago) |

I was standing in my driveway and hanging out with my friends. We were drunk and my friends had beers, but I did not. The cops circled the driveway and got out of their cars. They asked me for my id (I am old enough to drink) and I shook my head, no. They said they were responding to possible underagers drinking. I then walked into my house, locked my doors, turned off all the lights, and watched out my blinds. My friends stayed outside (there was a DD) and I heard the cops tell my friends that, since I was in my underwear, they were going to give me a fine in the mail for indecent exposure. Indeed my underwear were boxers with a button that closed the crotch hole. My question is: can they fine me through the mail, and can they fine me at all?

I'm not a lawyer, but I'm pretty sure the answer is 'no.'

Sounds like if you had boxers on you're good to go. You should get into the practice of wearing an undersized speedo when you know they're going to be around.

they can try but if they cannot positively identify you then who will they mail this citation to: "current occupant wearing boxers outdoors", what's more, did your underwear say "UNDERWEAR" because if they were not clearly labeled then how can they say for sure what you were wearing
if a citation were to come in the mail, it would be easy to beat

If you actually are of age then you should have just shown them your ID to prove you can legally drink. One of your neighbors probably saw you all out drinking and called the cops, so the police were only doing their job.
As for the indecent exposure charge, that was just them making empty threats

No. He doesn't have to. I wouldn't have shown them either. He was at home.

So if you're only 19 you can legally drink if you're at home?

Here 19 is the drinking age, 21 just sounds unnecessarily high to me. 16 should be fine for weaker beers below a certain % threshold I think, and liquor at 18. I've heard of some countries with a graduated system like this but I don't remember which ones. Making everyone wait until some crazy high age is just unrealistic, and I think it probably contributes to reckless binging once this delayed milestone finally hits.
If anything they should raise the driving age, IMO 16- and 17- year olds have no business putting everyone else on the roads at risk even sober. Big risk to everyone for little benefit. Ride your bike or take the bus or something, or get a lift with mom.

That graduated system sounds retarded to me. If i lived in a country with laws like that, i would just drink more of the weaker beer, or have someone of age buy me the liquor, drink it, than if i did something stupid resulting in cops i would say i drank a shitload of the other.

Well yeah some people are going to act like idiots regardless, but it's quite a bit harder to drink yourself to death on beer compared to liquor.
