Oregon May Expunge Thousands of Marijuana-related Criminal Records

WRITTEN BY EMILY GRAY BROSIOUS POSTED: 07/17/2015, 12:28PM Just weeks after Oregon legalized marijuana for recreational use, the State Senate has passed a bill that would retroactively expunge criminal records of people who have been convicted of possession, delivery or manufacture of marijuana.
As many as 50,000 people stand to benefit if Oregon Governor Kate Brown signs the bill into law – which she is expected to do, Fusion reports. Washington D.C. lawmakers unanimously passed similar legislation after legalizing recreational marijuana use in the district last year.
Why is expungement important for pot convictions?
Expunge Center explains:

“It really doesn’t matter if you had been arrested on a petty charge. The stigma of having an arrest or conviction record against your name can make it difficult for you to find housing, seek employment opportunities and obtain grants for school…. Regardless of how much you have changed or how many dreams you might have, one single mistake of your past can affect your chances of having a good future.”
U.S. law provides no provisions for retroactively expunging criminal records after something that was formerly illegal become legal. Oregon would be the first state to pass such legislation.
Under proposed Senate Bill 844, people convicted or adjudicated solely on marijuana crimes or acts – not counting motor vehicle violations – would be eligible for an order of expunction.
If Gov. Brown signs off on it, the new law would go into effect Jan. 1, 2016.

Now we're fucking talking. I always thought, sure legal pot would be good, but it doesn't matter if
1) pot smokers can't be hired due to drug testing laws(which it seems is being sorted out slowly but surely)
2) if people are still in jail because they were arrested the day before it became legal, and it stays on their records
The only thing we need now is to sort out a form of reperations for all the people's lives ruined by the drug war, i have never been arrested personally, but feel these people deserve some sort of apology from the government. And just to state, this is the only form of reperations i personally support. Most other efforts towards reperations these days, are to long after the fact, and the people whose lives were actually affected by things like, slavery, 1950's internment camps, and native americans land being taken, are an ancient cause, who while they did get screwed over, can't be here to accept the reperations.
Maybe the 50's japanese internment camps still could, but id only support the people actually in the camps, not their ancestors who might think they are owed for it.

Honestly, I believe that profiteers of the "Green Rush" should allocate part of their profits to fix that mess. Or, part of the tax dollars collected by the state should be used go fix problems *caused* by the state. Private monies could be write offs as donations (I'm sure the IRS would cockblock that).
The company who donates part of their profits to cleaning up criminal records, or job placement for non-violent marijuana offenders, etc will be shown to be true heroes and their profit margins will soar. They'd get free marketing and branding by giving money to people who have been wronged by the system.

This is more symbolic than substantive. The Feds have those arrest records and will not be expunging them, and the background check companies aren't required to delete the court records. The records system makes no exceptions for the innocent, it's an injustice we must correct.

That is fucking huge. I hope it sets the bar for other states that legalize in the near future. Expunging of most marijuana crimes is only just

I somewhat recall this being mentioned here and please correct me if I'm wrong..
As far as background check companies go, can't you just file a form or write them and a letter of expungement and they're obligated to take it off?
When I was arrested at 18 and charges got dropped a year later, I recall my lawyer taking care of all that and I don't remain on any records anywhere. I've since passed multiple apartment and job background checks and nothing has come up, and it was a class C felony.

So no one knows what is going to happen, I thought maybe bootleggers got pardoned or something. I bet it's going to be expensive a fuck to expunge all these records from all the databases. I think the cost and the drug war reperations should come from police and DEA pensions.
