So while my original statement was rife with inaccuracies borne of not being a lawyer, you're fucked in a car, and no amount of wanting it to be different will help.
it's still filled with inaccuracies, they can say the same thing when you open the door to your house, they can say "is that someone screaming" when you open your door. whether it's your car or your home, 'manufactured probable cause' is still just that but as your example has already stated, they say "I smell marijuana" and they search and find the drugs, then it's highly probable that they didnt manufacture the probable cause.

No they're not.
That's TV shit.
I've been arrested a few times, in different states, they never read you your rights.
Well then I guess you fucked up by not calling them out on it, huh?
or you dont have any idea what you're talking about, I've been arrested a few time without them reading me my rights or bothering to question me, if there's no questioning then there's no mirandizing

Most of that shit flies right out the window when your faced with the real situation. You can do all the reading you want but it will never fully prepare you for the real deal. I bet you're one of those people who also think that the police HAVE to read you your rights. This isn't a detective movie, it's real life little bro. If you truly believe that saying you don't give consent to a search of the vehicle will save your ass then you clearly don't know a god damn thing about how the law works.
If you've ever acted or taken any kind of film studies you would be able to tell cops is partially if not entirely fake. Look up Arizona vs Ernesto Miranda and tell me they don't have to tell you your Miranda rights at the time of arrest.

I concur. Even rock solid knowledge can outlive its usefulness as the law is a fluid, ever changing thing. I appreciate your input on these legal matters. I'm sure this has been said a thousand times, but are you a professional attorney?

I've posted about this before, but when I entered college, I had a weed guy for 3.5 years. I happened to hook him up with a straight job and he was my connect from then on.
Things got heavy and he kept bouncing around apartments and heavy foot traffic. He knew he was being watched but sold anyway. A friend was picking up weed one night and there was a horror film on. The cops busted down the door claiming they heard a woman in distress calling for help. Dirty motherfuckers.

Unless the show cops swarms an entire neighborhood with dozens of cameras, the shots that you see sometimes just couldn't happen without knowing where the perp would be. Id be able to point out set up scenes if we watched an episode together but I'm kinda slow at typing. Anyhow, I'm not interested in the carrot thing so I'm gonna dip on out of this thread I think.

A lot of fail in this thread. Police are not required to read Miranda rights when they arrest you. They are only required to read them if you're in custody and they intend to question you.

1. The average person, applying contemporary community standards would find, taken as a whole, appeals to the prurient interest,
2. Depicts or describes, in a patently offensive way, sexual conduct specifically defined by the applicable state law; and
3. Taken as a whole, lacks serious literary, artistic, political, or scientific value.
Judging by the porn that is openly sold in newsstands all over NY I would say that you would have to go way beyond a carrot in the ass to exceed any NY community standard

They are second hand distributors you are mentioning above. It is the manufacturing of very very graphic material that could get messy for the OP.
Selling titty mags and producing pornographic material like shoving a 9in carrot into a mans anus until it disappeared are different.

No. NY could go after them even if the content is produced out of state. They could certainly go after the sellers.

meh. its really irrelevant. I would rather be caught selling than manufacturing anything.
OP is going to see a lawyer Tuesday I think from my PM's with her. She ran out the clock on my offer and will get nothing from me. Your grape nutted boyfriend fucked you out of 100$ there ananaMoosey.
