As I read it, that language does not legalize the use or possession of peyote. It does however provide you a defense in court if you can prove a legitimate religious/ceremonial use of lophophora. You can still be arrested, charged, and incarcerated, even if you are a religious user, but you have the opportunity to have it thrown out if you can prove that use. That's how I understand "affirmative defense."

Yea I'm more worried for the authorities. They are the ones breaking a "law" if they attempt to stop any form of consumption. I'm concerned of any higher consequence they may face.
As for myself I feel safe.

shit so consumption for spiritual purposes means nothing to you guys? Well at least there is a defense we can use "if" cops decide to arrest someone.
Also this thread is redundant we've already discussed this. Lol.
And you're right it's not close enough. It needs to be straight out legal for growing and distribution so people don't need to go rip them out of the desert. Oh and so we don't catch a charge too.

You posted this thread, dude. If you didn't want to be redundant, you shouldn't have posted the same misinformation twice.
That portion of the law (the affirmative defense for religious purposes) has been in effect for a long time. It is also a far cry from legal in Oregon.

Ok I was just letting people know that it was included in measure 91. I posted in this subforum to get a knowledgable response. I appreciate your input.
People are allowed to consume peyote in Oregon for religious purposes. We've been allowed for several years. For whatever reason they made a few changes and attached it to the bill. So couldn't we say that in a sense peyote is legal in Oregon?
There is a well known church that allows people to partake in peyote ceremonies legally.
As a side note there is also a church in Portland that does Ayahuasca ceremonies. Kinda off topic but true.

It wasn't included in measure 91. It was already a part of the law before measure 91.
