Don't know much about law, but would peyote still be federally illegal?
Its just weird to me that they could so nonchalantly legalize mescaline.

Well the same could be said about cannabis... Even though it is legal at the state level, it is still illegal at the federal level...
And I am no lawyer or anything, but it seems to me that the way this law reads is that it is simply extending the general legalities that are already in place providing for 'religous' use of the peyote (NAC?). It doesn't really say what is construed as 'religious' use though. Like if you will be required to be a registered NAC member or something. So maybe if you are caught with it - all you have to do is say you have it for religious reasons...?
Either way, that's pretty cool, maybe the rest of the country will start following suit and start dismantling some of this 'drug war' the country is wasting all it's money on...

its going to be fucked if they try to decide who's use is 'genuinely religious' and who's is not

The text reads like it's just making it legal for the N.A.C. and such, several states already have that law in place so this is just Oregon catching up to the other states. I don't see this allowing general use or cultivation of peyote in Oregon, and you sure as shit won't be able to buy peyote at headshops.

Yea not much of a change. It has been legal for the Native American church in oregon for several years. Although this makes it seem like just anyone can claim its for religious purposes. Idk

its providing for an affirmative defense as long as conditions a. b. and c. can be proved. the proving is the hard part. try telling an elderly jury that you were safely using peyote as directly associated with a religious practice.

Subsection 5, printed right after the above quote is what really has me curious...
Quote:
(5) The affirmative defense created in subsection (4) of this section is not available to any person who has possessed or delivered the peyote while incarcerated in a correctional facility in this state.
Is this literally saying that it is illegal to eat peyote in jail...?

You guys should post this in Security and Safety forum and get some opinions there. I know next to nothing about the laws in the US. This thread is fine here though.

There was a similar discussion about using religion as a legal defense for peyote use or cultivation (might have been cannabis) a while back in the ask a lawyer thread.

It started somewhere around that post.

Just for everyone's edification, the part about peyote isn't in measure 91. The link in the OP contains the statutes as amended. The parts in bold are the new parts. Everything else was already in the statutes.
The peyote part isn't new, and it doesn't make peyote legal in Oregon. It just provides for a religious use defense. That defense has been there for a long time.

I was re-reading the measure. I am having a hard time trying to find where it says anything about Peyote. I read through the 38 pages, and can't find it, any part of the measure that relates to it.

It's on page 33, near the bottom of the page.

I'm about to rock your world. Press control-F and then type in the word you're looking for.
I control-F'd the word peyote and found it instantly
