Some people are not aware of their rights? In the US, they fucking read them to you when you are arrested. The very first thing they say is that you have the right to remain silent, yet almost no one uses it.

According to Erowid such cases are extremely rare. Like only a handful EVER. I think the prosecution might have second thoughts about taking this to trial. Selective prosecution is a real defense, considering these plants are sold on Amazon, EBay, and even your local Home Depot. Plus your friend wasn't caught actually extracting or consuming. He could have been making hippy soap with it 
Either way it would take a pricey attorney to successfully argue that. With a public pretender he'll probably just have to suck it up and take a plea deal.
