Sick man raided for pot can't understand reason

A man caught in the clash of state versus federal drug laws told News 4's Brian Maass that he couldn't believe federal agents raided his home for three marijuana plants he'd grown for medicinal use.

Donald Nord, 57, has a state permit to use marijuana to relieve chronic pain from cancer and diabetes.

Federal agents, acting on information that Nord was growing marijuana, got a search warrant and found three plants and growing equipment. The agents confiscated it, and Nord was given a ticket to appear in county court in November.

The case was thrown out and, on Monday, the county judge ordered the Drug Enforcement Administration to return the plants and the equipment. The DEA says it won't give them back willingly.

"I don't understand why the state says I can but the federal government says I can't," Nord told News 4.

State law allows medicinal users, with the recommendation of a doctor, to go into a registry of those permitted to smoke, grow or otherwise acquire marijuana. Federal law prohibits all possession of marijuana.

The judge gave the DEA 21 days to return Nord's property.

Jeff Dorschner, spokesman for the Colorado U.S. attorney's office, said staff will review the county judge's order for the return of the marijuana.

Oh man, I wanna see the turn out...cuz I doubt the DEA will give them back, they've made it clear in the past. Lets see what power the court has :laugh:

i'm thinking this guy has more than enough to worry about without being illeagaly searched by a zealous federal govenment.

it is sad to say, but this guy dosen't likely stand much of a chance of getting his confescated equiptment and plants back, but i'd hope he'd be safe from a second incident in the future, though i wouldn't count on the federal law enforcement giving up on him. they do not seem at all reserved about spending out tax dollars on another pointles case that will be thrown out the second it sees the bench.

Cases such as these lead me to believe that the DEA has nothing better to do than raid victims as described in the news story. Whatever happened to meaningful raids?

My question is, why did they NOT go over this list before obtaining the warrent and raiding his house?

May make a good case for the individual or State to sue the Federal government for violating the IV Amendment of the United States Constitution.

It's really sad the DEA goes after sick people with a few plants.

What about all the crack heads and dope dealers (not pot)

I guess they would rather go after the weak and sick.
They don't fight back.
