I dont know why ppl going to trail choose the jury over the judge
    #21773760 - 06/07/15 11:50 AM (8 years, 7 months ago)

Just a heads up. Jurors are in court w/ likely very crappy attitudes, because they would rather not be bothered w/ the duty of being a juror in the first place, and for many good reasons. But explain this supposed wisdom in choosing jury over choosing judge, since it just boggles my mind.

eta: In title I meant trial, not trail. lol.

a judge is an expert on the law, and will judge you based on their interpretation of it.  Jurors can be swayed by emotional arguments not necessarily related to the law.

U mean like crimes of passion? By emotional arguments? But most men are not emotional like usually women tend to be. I guess women should choose jury, but never men. Men shouldn't risk being called a monster for not showing certain looked for emotion when during trial.

I have a laughing tick or whatever it is called. I just find, for example, if my life I myself am looking at as ruined, I'd find humor in that, and start laughing. But I cant help it. Even when I was a kid I'd some times laugh for no reason. And that no reason itself I'd then find more funny.

Welp i surely know better than to choose a jury. I know my usually finding life funny when I'm in something serious no court would allow me to explain.

There are myriad reasons that a jury trial is advantageous.  I assume you're talking about criminal cases, so I'll limit the discussion to those:

1. A criminal verdict (generally) has to be unanimous, so one dissenting juror means a mistrial.  A judge is always unanimous.

2. You don't get to pick your judge.  You do get to pick your jury.

3. Judges are often former district attorneys.

4. As the plumber said, emotional pleas work better with juries

5. A judge will see all of the evidence in a bench trial, whereas certain evidence can be hidden from the jury.

Having said the above, there are rare instances where a bench trial is the better choice.
