I agree with it taking too long. Appeals should start/end quicker. I heard it is the paperwork involved that takes up most the time. In a better justice system 1-5 years seems more fit. But then I would expect the death penalty to be given to individuals who have some pretty solid evidence against them. I've read of some of the innocent who have been executed which is why I am generally against the notion unless the evidence is ridiculously compelling like this asshole taking blatant responsibility for his actions, and then the loads of evidence that follow. However, I like the material Christopher Hitchens produced against the death penalty. I guess I am slightly undecided but leaning towards abolishing the death penalty. It might cost money to keep him in a supermax, but atleast we know it is absolutely horrible living conditions.

Google says that in cases where death penalty is sought the jury decides.
Off the top of my head though, I think the judge still has final say in the matter.
