Boulder DA: No charges in home-invasion killing; intruder likely on mushrooms
Shooting falls under Colorado's 'make my day' law, prosecutor says

The Boulder County District Attorney's Office will not file charges against the Boulder man who shot and killed a University of Colorado student who broke into the man's house on Pima Court and attacked the resident last week.
Robert Zamora, 19, reportedly broke into 98 Pima Court around 8:40 p.m. May 4 and was subsequently shot and killed by a resident in the house, Jim McCain.
District Attorney Stan Garnett today announced he has decided not to charge McCain in the case, citing Colorado's "make my day" law.
Garnett also revealed that Zamora is suspected of being under the influence of one or more drugs, specifically telling the Daily Camera that he is believed to have used psilocybin or "psychedelic" mushrooms.
"At 98 Pima Court, Mr. Zamora entered the home forcefully and without permission and then aggressively attacked the homeowner," Garnett said in a statement. "The facts and evidence in this case, which have been carefully and thoroughly investigated by the Boulder Police Department, fit the type of circumstance to which the 'make my day' law applies and the homeowner would also have been justified in his actions under Colorado self-defense law.
"Therefore, there will be no criminal charges filed against the homeowner in this case."
Colorado's "make my day" law allows homeowners to use deadly force if a person enters their residence uninvited and either has committed a crime other than trespassing in the residence or intends to.
Garnett also said in his statement that Zamora may have been under the influence of psilocybin mushrooms at the time of the break-in.
"Final toxicology results from the autopsy are pending, but Mr. Zamora was reportedly under the influence of at least one drug at the time of this incident," Garnett said.
According to Boulder police, Zamora had attempted to enter several other homes in the area, banging on doors and windows, before banging on a rear window of 98 Pima Court, prompting McCain -- who was in the house with a woman -- to grab a gun while a woman in the home called 911.
Police said Zamora then broke the glass storm door and burst in through the front door. Zamora attacked McCain causing the two to fall to the ground and begin fighting, according to police.
McCain fired a single shot from a handgun, hitting Zamora in the chest and killing him.

Hooray! I don't care what the circumstances, everyone should have the right to defend their home as much as they have the right to breathe. Under the influence or not that kid lost his human rights when he stole the rights of the homeowner.

I'm not sure what they mean when the young kid began "fighting with the home owner." On the other hand if someone comes into my house in the middle of the night breaking through my windows i'm going to shoot whether he is fighting me or not.

Had to be mushrooms of course. Why cant people get a grip on themselves? I never mix substances and rarely trip alone unless on low dose natural or non-research chems. Sad for the guy and his family but of course the homeowner did what he had to do. RIP crazy guy...

I think this person was most likely unstable before taking any substances. It's an easier narrative to understand Man + Drugs = Violence rather than telling his life story and background. You also have to remember much of this is just click-bait. News is about attracting viewers to run a business, not providing stories about what's happening in the world.

One of my biggest fears while tripping is thought, what if im tripping so hard that i think i left and returned to my house, but in reality i accidentally walked into someone else's house, and i won't realize it till i wake up in the morning.
To really sum up my biggest tripping fear, i always wonder what if i only think im doing X, when really im so fried im really doing Y. (And then i always substitute y for the most fucked up thing my fried mind can conjure up)

I doubt he was on psychedelic mushrooms. I'm not buying it until I see a toxicology report. "Make my day law" lol couldn't they just call it the right to defend law. I doubt it makes anyone's day to have to kill an intruder and deal with a police investigation.
