Just started a new (2nd) job

I'm a nurse and I just got this new job where I'm at peoples houses through the day. Being as how it's a new job I don't want to complain but I'm pregnant and also I do not smoke and this lady chain smokes in a tiny cramped apartment with all the doors and windows closed for 5 fucking hours every day. Not only do I feel bad for my baby but I'm physically sick when I leave there and my clothes and bag reek of smoke.... I even came outside today after finishing my work and had to puke before getting into my car.

How wrong of me would it be to ask for a different client? Can this get me fired or hurt my employment in any kind of way? Idk what to do, I want to keep this job but I don't think my health and the health of my baby is worth it.

it wouldn't be wrong at all.

I would definitely at least inquire about changing clients.

I work around someone who smokes and lot and it bothers me but I'm not pregnant so I don't do anything about it.

Yeah I wouldn't say anything about it either but it's really making me sick. I still have nausea hours after coming home and I just don't see being able to do this every day.

your point is view is a valid, realistic one at that. it cant be healthy to be stuck in a hot-boxed apartment all day while pregnant. and anyone who isn't concerned over the well being of your unborn child is a moron and a fuckin asshole. I think your company would be very understanding of your situation and gladly replace you with someone else.

if you were to get fired over something like this, I see a big lawsuit with maddddd dolla billz in your future.

Yeah, it is entirely within the environs of reasonablity to ask not to be exposed to second hand smoke of such extent, or any extent for that matter.  This would be true regardless of the pregnancy, but the pregnancy trumps all other considerations. 

From americanpregnancy.org:

Many women are exposed to second hand smoke from friends and family members or the residue cigarettes leave behind.  These types of indirect contact with cigarettes can also have detrimental effects on the health of you and your baby.




From Health Canada:

I'd say that it's not only correct of you to request a different client, but that a refusal from your employer would be grounds for a lawsuit.

They're saying because I was just hired changing clients would count against me when the review of my 90 day probation came up and that I would be fired or not get my pay raise... I'm probably just going to quit, going to that place is making me sick and I've already had a lot of problems with gaining enough weight.

Also everything closed down early the other day so I had to go get my kid out for my sister to babysit. I go in at 12 and I called and they said just be there as soon as I can and to call when I get there. I got there at 12:45 and called and the lady on the other line says "ok well I'll just write down 1" (now normally I would just let this go, it's only 15 mins but this company has already proved to me they treat employees like shit) So I say "ok well I'll show up 15 mins late tomorrow and write down 9 ok?" and she says no I can't do that, that would be fraud....so I asked her if she worked for free because I didn't. To that I got a disgusted ugh from her and she finally was like just write down the time you were there.... Me: Ok Thannnnks! in a real fake voice.....bub bye lol I'm probably getting fired anyways over that 15 mins now but damn, I don't really want to work for this place anyways.

Wow, that's a pretty lousy response from them.  I'm pretty sure they can't force you to expose yourself and your baby to health risks, and that their insistence could form the basis of legal repercussions against them, but that might be a question for Enlil.  In any case, it sounds like any rocking of the boat is going to cause them to drop you, justified or no, ethical or no.  In your position I'd just walk away.

I'm confused.  You are going to suffer 2 more weeks of cigarette smoke to you and your baby?  I'd also call the health department and report them for sending a 5 month pregnant woman to a chain smokers house and then refusing to find you another place to work.  Of course this is Georgia so it probably won't matter as you are close enough to North Carolina where smoking is probably a God Given Right.  Then to try to cheat you on your time paid?  Uh huh.  Get your pay, if they short you don't accept any of it and tell them you will see them in court.  Then the fun really begins.

Seriously, you need to stand up for yourself and don't let shit like this even happen for this long before you take real action.  If shit is making you sick, it's making your baby sick and you need to move on it and now.

They're actually pretty strict here, I can't think of anywhere you can smoke inside besides pool halls. The 2 week notice is so it doesn't look bad on me, they can't say shit if I leave one and I really don't need that following me around. Idk how I would even go about reporting them or why they would send me there knowing I was pregnant in the first place.

Why don't you give this a quick read over, and then call somebody up, tell them your situation, and ask them what to do. I'm sure that they'll be a little outraged, and want to give you some good advice. It sounds like your employer might be breaking the law by insisting on exposing you and your baby to known health risks. If they were strict about doing the right thing, then they would reassign you to a safer environment. Instead they're violating your worker's rights, and probably some safety regulations as well. I'd be surprised if they're not clearly in the wrong on this.

I completely agree that two weeks notice is ridiculous in this case. If your next employer asks why you left your last job, just tell them what happened, and if they're not disgusted and sympathetic, then don't work there either. It's obscene that this would be tolerated in a health care working environment.

The trick with this kind of bureaucratic bullshit is talk to a real person and ask for directions. Call whatever number you can find, and then politely impose on whomever answers for help. Chances are good that they know their organization well enough to send you in the right direction. Often it takes a few tries and some dicking around, but when you get to the right place and find somebody competent, it can pay off.
