sorry if this has been asked before...

I seem to remember hearing before that psylocibes are only illegal in the US once they are prepared for consumption or something like that, is this true?

1) What if they are growing on your property?
2) what if they are growing in a jar in ones vehicle or home?
3) What are the exact rules regarding legality?

Mushrooms are a schedule 1 drug. They are as far from being legal as they can get.

Actually, one or two specific species are schedule 1, and Cubensis is not one of them. Psilocybin and psilocin are scheduled, which magic mushrooms contain. Either way, you get busted.

State law... fresh are legal if you don't know what they are. Dry are illegal no matter what. They can still bust you for fresh at the federal level regardless.

Basically if you have mushrooms or mycelium and happen to be residing in the US, you will need an attorney and plenty of money for fees and fines. Jail time is highly probable.

This could well be a legal time bomb that will be used to confiscate family farms and hand them over to the likes of Cargill and ADM. In the past you could not be charged as long as the mushrooms were growing outdoors and *not removed from the soil*. Removal from the soil constitutes intent for human consumption. If this is not so, then the junta technically has a valid case against every cattle rancher in the country; and no doubt it will reap more windfalls for wealthy farming corporations.

Here in the UK its fine and dandy to be in possesion of Fresh shrooms from a field, its also legal to grow them. Ive found out recently you can also buy them from holland since fresh mushrooms arent illegal to posess alot of the head shops are doing mail order on them now.

yeah I've been in head shops in the UK and they are selling grow kits, some shops are even growing mushrooms in the kits on the premises (sp?)

aye they are mate since its not illegal to have fresh mushrooms on u, i think their has to be 50% water ,in them to be legal.

Not so, the law is not so precise. It doesnt mention mushrooms at all - it just says any 'preperation or product' containg psilocybin is illegal. If you have caused the mushrooms to become dry then a 'preperation' has been created, whereas if they have become dry with no intent, they are still legal, though this is a bit of a grey area.

The law in the UK is a very grey area, in the case of R. vs Hodder packaging and freezing was deemed 'preparation' by the court. Fortunately mushrooms do not seem to feature high on the lists of anti-drug zealots here in the UK, but I suspect a high profile case, especially if it involved children would provoke the usual knee-jerk reaction.

I suspect the police are not that bothered about mushrooms, they are not an exactly crime causing substance, if it were funky wallpaper would be a good for catching burglars.
