Legal advice

Say you got into a contract agreement to make payments on a vehicle..only the contract says I _____ except (instead of accept) full financial responsibility blah blah..

Is the contract void due to the mispelled word which changes the terms of the contract?

Side note: bought car from former coworker shortly thereafter and $1100 in payments and another $600 in maintenance later the car is really crapping out and evidently had a huge ($700+) fix which I was not told about and also had to fix several issues which the selling party failed to mention.

Basically got fucked buying this and since I've had to change the fuel pump and a sensor in the past week, im a month behind my payments. Dude was being a real dick about it and threatened to sue me and all kinds of shit.

Funny thing g is he fucked up the contract. I noticed when I signed but I didn't really trust the guy and signed anyways.

Am I fucked or whaa

I think since this doesn't really change the meaning of the sentence in a way that would make sense, a misspelling will not result in the document being thrown out.

Quote:

Misspellings usually are not grounds to argue the non validity of a document. The Rules of Civil Procedure, as well as criminal procedure, allow for what are known as either a "Harmless error" or a "Plain Error". A misspelled name is known as a Misnomer.

also from that discussion:

We had to read Jerry Garcia's will as part of our unit on equitable trusts in property law. There were a LOT of friggin' typos in that document. And apparently, that held up in court. Of course, given the date it was drafted, I was a bit surprised a spellchecker inside a word processor didn't just catch them...

  Jerayyyyy

Of course it is possible the document would not hold up in court for another reason.  I am not a lawyer, and it depends on what is in there protecting you or maybe something he did that invalidated it, or caused it to not be valid in the first place.

I'm guessing that since you're behind a month's payment you've owned the car for more than a month.  That means you're unfortunately not under "lemon laws" if I remember right, but that is something you could check into.

Look into lemon laws and buyers remorse for your state.

The misspelling won't work

He's right!

I missed out on the lemon law when I had my Jeep Grand Cherokee. Missed it by 1000 miles. I hope you've kept all receipts and records. You may be able to turn around and make a full comeback.
Laws vary from state to state. I ALWAYS avoid asking friends or coworkers for money because a relationship that was once manageable  is now poopy because of financial obligation between 2 parties. Same thing happens when you get married. You're putting down the road of relationship, everything is just fine- then you get married- all of the sudden there is a financial obligation and things have a chance to turn poopy.

"Shutters"

I've been there.  I'll just make my own money from now on.
Good luck.

They'll probably say it's your fault for not noticing it before signing it.

Bend over.

used cars are sold "as is" unless a warranty is specifically stated in the
financial agreement, it's your responsibility to check out the soundness of
the car and the seller may not have know about an issue that was upcoming
especially since that could be due to your driving habits and maintenance

now, a simple rule of thumb, if you dont trust someone, dont do business with them

some new information which I think helps me out tremendously!!

So i read all this, and said fuck it, i'll pay it off.

gave my girlfriend the $$ to pay and get the title.

turns out, they took a title loan out on the vehicle either before it was purchased or after they sold it to me..so they didnt have the title to give me.

They were threatening me with all kinds of charges and sues..

But I believe the tables have turned, seeing on how I unknowingly bought a vehicle with a title loan out on it, can I sue them for my money back and press charges for selling mortgaged property?

<3 universe is on my side it seems

Yea man they fucked up getting that title loan.

I would get a bug detector and make sure it's not being tracked

Don't make any more payments

Then hold the vehicle until they give you your money back.

Make sure they don't try and steal it

They'll do shady stuff like try and get your friends to steal it for them so watch out

Might wanna talk to a lawyer I don't think they stand a chance in court
