Ok here's the situation:

I have court tommorow for driving on a suspended license.. apparently in Virginia, that's the second worst driving offense you can have next to a DUI

Here's how it happened:

I had no tickets for the first 4 years of driving.
I physically lost my license about 8 months ago. I didn't have my car at the time so I didn't worry about it. I went to the DMV to get it back.. no problems. In a period of one month, I accumulated 7 tickets.
1 moving violation (speeding 10 over the limit)
6 non-moving violations (while my car was parked, two sets of expired tags tickets, two sets of expired city sticker, two sets of expired inspection).. isn't that double jeopardy?

Anyway.. I lost my license again.. so I went back to the DMV to get a replacement. They said I owed personal property taxes and a ticket, so I went and paid those to get my license back.

So I had my license, and I thought everything was fine. I had some tickets due but not for a month. Well I was driving and I got pulled over and the cop told me my license was suspended. Apparently I forgot to pay the speeding ticket, and didn't show up for court...whoops.

So the cop took my license, and I got a summons for driving on suspended. Now here's my deal:

They never sent me anything in the mail saying my license was suspended, which they are supposed to do. I had just gotten my license replacement at the DMV - TWO DAYS prior to getting pulled over. The DMV never told me anything about it being suspended, and normally they won't give you a replacement if you have unpaid tickets, and they will NEVER give it to you if it is suspended. So in that period of two days my license was suspended, yet I received no notice of it. I was driving with it suspended but I didn't know it was suspended until the cop pulled me over and took it from me.

So I've been running in circles trying to figure out how to get it back. I've paid almost all of the tickets, and I completed a driver improvement class (which is supposed to take 5 points off your driving record)

Now my question is this:
Should I go in and plead guilty.. and hope the judge takes it easy on me and sees that I have been paying tickets and took the driver improvement class?
Or should I plead not guilty and get a public pretender.. and go through several court dates to try and get off?

Plead guilty and tell that whole story. Say you are sorry and you learned your lesson. Try and look nice.

id say it doesnt matter if you say guilty or non guilty-
just give the explanation that you didnt know because the
retarded DMV said nothing

maybe guilty-with-explanation is the best way after all.. hmm

I would be pleading Not Guilty. You were unaware and uninformed by the proper authorities that anything was wrong. I would suggest that you go for a consultation with a lawyer and explain exactly what you just did here. He/she will be able to tell you exactly what to do. I'm almost positive they will tell you to plead Not Guilty. Pleading guilty to a crime as bad as that is not a good thing. As soon as they hear you plea guilty, they will think you are, for the simple fact that you have admitted to doing wrong.

Speak to a lawyer before you do anything.

Well I just realized the clock on this computer was off by a day and I don't go to court until tommorow

But yeah.. I talked to a lawyer and he said $500 if you want me to represent you in court.. which if I plead guilty my fine will be like $300... stupid lawyers.. anyway I think I'm gonna go for the public pretender.

If you are really worried about getting screwed, i would suggest getting a 'real' lawyer. When i got charged, i didn't have the cash for a lawyer.. so i got a duty councel.. I ended up getting so fucked over..

But the public pretenders here may be different then the ones where you are from. Here they just dont care cuz they aren't getting paid, so they dont do everything they can to help you. The bastids!

I gotta go to court in a few days for driving without a licence.
I was joy riding in my pops car. I was like "oh i'll be fine if i just drive ok" Forgot to turn my lights on as i was pulling out of friends driveway. Busted. Im in texas and have a felony on my record.

i think thats the way they are regardless of your location...

i had the same thing (well sort of) happen to me... i had a bunch of traffic tickets i had to take care of, but i got caught up in a whole bunch of drama in other areas of my life and these tickets took a back seat while i was trying to sort things out elsewhere, and never got taken care of. my licence got suspended, and wont get it back till i pay the fines. since i never went to court, i cant fight the charges, which really sucks cause had i taken care of them when i was supposed to i could have got most of them dropped/reduced. the DMV also never sent me a notification (the courts said they dont have to)

so im stuck with out a driving licence until i can pay off the 853 bucks :frown: ouch!

i almost got them all paid off, got another 200 bucks or so....sucks!

That's the stupidest shit i've ever heard! How they hell are you supposta know if you have a suspended license or not? What a great way they have of totally fucking us over..

Outcome:

I owned the court.
My case was called, I was in a fancy suit. Judge told me max penalty I could get, asked if I wanted a lawyer, said no, plead not guilty.
Cop told judge what happened. I told judge didn't know it was suspended, said I haven't been driving, blah blah blah..

Judge says: Annulled!

I win!  :grin:

I was a little scared too.. because the guy a couple cases before me had the exact same charge..only he knew his license was suspended when they pulled him over. He got fucked.. $500 fine, 10 days in jail, 90 day additional suspension, and something else. He got the maximum penalty and he plead guilty and everything.
