A judge has given an absolute discharge to a man charged with trafficking marijuna after police raided his Lions Bay home and found 414 marijuana plants, although almost half most were seedlings.
Michael Santos, an audio engineer with no criminal record, pleaded guilty to possessing about three kilograms of marijuana for trafficking.
The police raid took place on Feb. 28, 2013, when a battering ram was used to break the front door when no one immediately answered at Santos’ rental home, where he lived with his wife and two children.
The court was told that Santos, 40, grew the pot as medical marijuana for himself and gave the rest away to others in need of medical marijuana.
Provincial Court Judge Joanne Challenger noted that Santos, at the time, had not sought a medical exemption to grow pot and use it to treat his condition, which he asked the judge not to be made public, so the judge sealed his letter that explained his expectation to develop a life-threatening genetic disease, given his family history.
“Given what Mr. Santos knows about the disease he is predisposed to and the effect it has had on his family, I accept that his medical use was and is sincere,” the judge said in a recent written judgment. “Even if the only benefit the use of marijuana actually provides is hope, the emotional and, in turn, physical benefits could well be medically significant.”

Yeah, great article. However, I think the judge is wrong when it comes to "Modern social values". Who cares, so if he lived a few years earlier and had exactly the same moral character he should have his life thrown away just because society has a slightly different perspective? This should be about the fact he was not doing anything violent, and therefore it should not be up to the law to prohibit what he's doing as they can clearly be wrong.

I wish more judges would start doing this, and judges rejecting charges brought on by prosecutors against non violent marijuana usersfor personal use. A message needs to be sent that these laws need to go. End marijuans prohibition, this guy could have been sent to life in prison for he had been arrested just 5 years ago. Maybe if he was arrested even 1 year ago he might have been sentenced to life.

Well... thats a reason to smoke...
Personally, I have a disease where I like to be stoned all the time...
" You gotta understand sir... cancer runs in the family... so to make sure I never get it...I get high all the time" ..... valid.

Try to be funny? The mans "almost certain death" dude listen to yourself. He doesn't have any diseases. He's bracing for the possibility of getting one... by smoking weed.
Yes. Cannabis is healing. If ingested internally..which would seem more valid for "disease prevention" Smoking weed doesn't ward off or prevent anything aside from chores and lack of appetite.

He could have Huntington's. Basically you kook forward to turning 30 so you can forget everything, lose your mind, and sit there flailing your limbs all over yourself. The stress, fear and PTSD of seeing a parent or sibling have it would drive me to smoke every day. Regardless, I find it deplorable you're hating on this guy for getting off when you should be celebrating.

I'm not "hating" on this guy. I advocate cannabis for all, not just the sick. Just seems like he's blatantly full of shit. that's it.
