If I have a friend who sold ~ an ounce of shrooms years ago, how long can this apply if someone who got caught tried narc there way out via this person?

Assuming the person grows now for personal resource, and made that one slip a long while back, can federal agents come pounding in years later and bust this person still?

Similarily, is there any legal leeway for personal use versus intent to distrubute?

As long as the person is clean now, the police probably won't waste their time or money. Not because they are nice, but because they need evidence to convict and it is easier to go after fresh cases than old ones.

They have 7 years to press charges and convict for all crimes except rape and murder.

Thats what the teacher of our governments class said anyway.

If your friend is named to the police as a possible drug dealer, the cops could easily come round to check him out, regardless of how long ago the specific incident happened - the police aren't to know that he only dealt once.

Technically the answere is yes.

? 12-12-17 Statute of limitations. ? (a) There shall be no statute of limitations for the following offenses: treason against the state, any homicide, arson, first degree arson, second degree arson, third degree arson, burglary, counterfeiting, forgery, robbery, rape, first degree sexual assault, first degree child molestation sexual assault, second degree child molestation sexual assault, bigamy, manufacturing, selling, distribution or possession with intent to manufacture, sell or distribute a controlled substance under the Uniform Controlled Substance Act, chapter 28 of title 21 , or any other offense for which the maximum penalty provided is life imprisonment.


But realistically, the cops aren't gonna act on that dated a tip. But the fact that you grow anything, even for personal use is dangerous because this Narc could tell the cops he/she bought from you 2 days ago and you have a crop in your closet. Cops may be inclined to watch you.... and you do have a crop in your closet. You know the risks involved.

there is a great difference between this and something which a statute of limitations could apply to.

to get a warrant, they have to be able to show reasonable cause to believe that a search will yeild evidence of a crime.

some con telling the cops that he bought a bag off your buddy years ago ain't gonna cut it.

Well mushmaster, I have been illegially searched twice. Once they claimed that I had a pipe in plain view (it didn't exist, but they said they lost it) and once they lost the video and claimed I had consented. So basically the gov't said to hell with the constitution a long time ago. So you can't be too careful.

Well.... my post was based on potentials and hypotheticals. But, I know Im right. As Z@z.com stated about being searched, it Dont effen matter to the police sometimes. The statute speaks for itself. It gives them the right to investigate the matter. They may not find the evidence right away but it will happen eventually. I watched a neighbor go down for growing KB. Unmarked squads watched the house for 2 weeeks before he was taken down. But lik eI said its unlikely the cops will act on such an old tip, dude just be careful, shit!

Very true.

Actually, they only have to convince a judge of the above... they don't have to show anything. Most judges would require more than something an informant claimed happened a few years ago... but with police work, a few years ago can easily become a few days ago (just like that oz of cannabis turned into a few pounds by the time it gets to the DA, even though they can no longer find it)...
