Maybe you guys can help me, I'm not sure if what happened to me tonite was legal. Here's my story.

Tonight I met up with some friends at a University. They wanted to go to a party downtown and since I have to work early the next day, I volunteered to DD.

We get down to the location of the party and I see a parking lot with open spaces. We park and head out to the party, only to find it being busted up by about 4 cops. We walk around a little bit, and when we go to leave I notice several security cars and a large tow trailer in the parking lot. I tell the four people I'm driving to wait while I see what is up.

I approach the security guards and they ask if this is my car. I say yes. They say it has a wheel lock on it, 60 bucks or your car gets towed and you pay 200 dollars. I say I have 15 dollars. They leave to go work on other "illegaly parked cars"

I am completely sober and about to go irate. The head guard is in a shouting match with some drunk kids about how they aren't real cops and they better let them go.

Eventually he comes back around to me and I tell the guy I can't make 60 and if my car gets towed it will break me. He says 30 dollars in ten minutes. So I go to my friends and they give me the fifteen dollars I need. I give him the money, he sends his bitch to pop the boot off of my car and pockets the money.

My question is, was this legal for him to shake me down. He said I was parked on private property and was tresspassing. Do I have legal recourse here? Or should I just let it go?

Yeah, let it go...

If they have the authority to "boot" your car, then don't look at it as a shakedown because you talked them down from $60 to $30 -- look at it as negotiation! You were very lucky, I'd say, to find someone willing to take less, and possibly pocket it, rather than say, "fuck you," and leave you to pay $200 to get your car out of impound... :smirk:

You did good, it seems to me... :wink:

In my state, If you catch them in the process of towing or booting your car, they are legally obligated to let you move your car.

once theyve already done it, tho, you're kinda screwed

First off always take names and badge numbers ect. when dealing with police officers, make it a habit these are not decent people so beware anytime you have to deal with them. There is numoures hotlines you can contact people who will deal with this in some manner. Always report them to their superiorers, write a letter or two decribing how these people are acting while they are out on duty.

How about just following the rules when you are on someone else's property, and be willing to accept consequenses for your decisions instead of crying about it.

NO Way...

Dont let that shit happen... Let it go now cuz theirs nothing you can do about it but if your wereparked legaly then they have no right to boot you or fine you. If they pushed the issue I would get out the disposable camera (always have one in your glove box) and start taking pics, of the area and ask for a reciept..

Hell... If you gave this guy money you can still go and ask for a receipt.. Go to the security office and ask for the record of your detainment and ask for a reciept. Say that you can write it off for work or something, or just tell them that its your right to get one.

NEVER let your rights slide. Do what your told to do but keep note of who is involved and get witnesses. The next day begin questioning if it was right or not and ask the right people, like their boss.

Okay, a similar situation happened to me. . . University cops, I didn't have a parking permit, so they booted my car. . . didn't matter though, I had no need for it anytime soon, so I ignored it.

However, I got a letter saying I had to pay $150 to get the boot removed, or my car would be towed, mainly due to the fact that they were low on a supply of boots, and mine had been on my car for months, and they wanted it back. . .

I went out to my car, took the boot off myself, and returned it. . . they tried to take me on legally about that, because I flat out refused to pay the 150, I went to the University court (Judical affairs) and displayed the letter they gave me. $150 TO HAVE THE BOOT REMOVED. . . well, they didn't remove the boot, I did that myself, so I didn't see why I owed $150. . .to make a long story short, they revised the boot rules after that, and I saved $150 bucks.

But in your situation, they say you were on private property. . . if its university property, you're screwed, it done and over with. I probably would have just taken the boot off myself, seeing how thats what they wanted the 60 for, to remove the boot so you can move your car so it wont have to be towed. . . I would have taken it off myself, and drove off.

A friend of mine got in major shit in Denver because he had his car towed after they booted it, with the boot still on the car. A $60 tow fee + an angle grinder got rid of $150 fine and car boot. The lot sent the cops after him for steeling their boot. He kept the attitude that they shouldn't have put it on his car, and that they were at fault, not him. I am not sure, but I think everything eventually got dropped. I will have to ask next time I talk with him.

Cops ARE decent people, by and large.

The local cops are just doing their fucking jobs, keeping law and order in the states. It's not their fault some of the laws are unjust. You don't win over hearts and minds (as we need to do if any positive change is to happen) by acting with disrespect towards the lawmen.

Many of them are. I have even known a few very cool cops that would sit and spark a J if they were off duty. Not all cops agree with the WOD, for example.

However, there seem to be a lot of people that become cops because they have a holier than thou, hall-monitor mentality. For every good cop that I have met (and I have met a lot of very cool cops over the years!) there are two or three that think they are God's gift to mankind and love nothing more than to abuse their power and position for the ego trip it gives them.

Thanks for the replies.

It's been several days and I think I will just let it go.

I spoke with some family members about this ordeal, and they said that security guards like this basically have a license to steal.

The reason I view this a way to generate income is because this took place at midnight in a fairly vacant lot. I bet this happens on a weekly basis because this took place in a party area in a college town.

Baby hitler: The parking lot was posted, but it was a small sign on a gate that was open and not readily apparent.

THe only reason I didn't totally make a scene was because I did not have my Drivers license on me. I have a feeling that if I blockaded my car and refused to let them tow it, they would have called the real police and they would have been more sympathetic to me, I guess it just depends on the officer.

Bio hazard, how do you remove a boot?
