I was just outside of the kitchen area where "line" is that consists of the salad, sauté, grill, and so on. There is an alleyway that has the drink/coffee station and it is behind a wall that is the dining area. I am not saying he is just a dick for no reason, it just seems he was being a dick to me on that occasion. I was right by a trashcan and away from the drink/coffee area.
He actually left and gave me my license back. Then he returned the next day and proceeded to write me the ticket! I know he must have looked up my name and being a government official probably looked at all my history.
When I told him about me becoming a nurse and this is my last year of restaurants etc...he looked at me and said in a really weird tone while looking me straight in the eyes, "I know everything about you" very creepy! And then he made a comment of "I don't mind going to court at all". And was just really being a fucking prick to me for no reason other than he had the power to do so.
WTF am I supposed to think about that? This is really just such ludicrous BS! I am going to trial for a 2oz cup of some soup I was not even eating! A FUCKING TRIAL!!!

He also could have just given me a written warning. Like I said before, 29 years in this biz and I have NEVER seen or heard of this happening. I have worked at many places from corporate to single owner too.

No he did not. When I talked to him the next day before he gave me the ticket I said to him point blank "you did not see me eating anything, I just had it in my hand". He replied "then what were you doing with it then?" I said I was checking it out for a guest (as I do all the soups almost everyday along with everyone else). The fact that he said "then what were you doing with it then" is an admission of him not seeing me eat it!
I can't even believe I am making this ridiculous post about the matter! FUCK!!!
Just wanted to warn other people in the biz that this could happen to you, and I will post results. Thanks for reading all of you!

I have a court date in 3 weeks. I can choose either a jury trial, or a bench one. LOL! I can see a jury trial now, "We the jury find the defendant"... Fucking hell!
I am getting a map of the restaurant and show where I was standing, a signed paper of people saying they did not see me eating anything either (I can get at least 2 people to do this), and the date I started working there to show that the date he wrote on the ticket is wrong. Armed with those 3 things and the truth I should win.

That's pretty petty. A 2k dollar fine just because you were holding a bowl of soup? There are way worse things that happen in america than this for the health dept to be concerned about. Foor borne illnesses running rampant due to cross contamination of food and such.

Yeahh He sounds like he was being a total dick, I was just saying there may be a legit reason behind what he did, but he didn't have to go about it in that manner.
That's what gives advisors and inspectors a bad reputation and makes everyone hate us as soon as we set foot in the place.

Joking aside, with a fine of just $340 like you say. It will cost you much more if you fight it (win or lose). For one thing lawyers don't come cheap and every time you go to court with or without a lawyer it will cost you time at work and even more money if you lose.
So unless, you have witnesses to back your side of things it may be very wise to just pay the fine,cut your losses and never let it happen again.
You can bet that 100% of society wants clean and well run kitchens without health violations. So all a judge and/or jury will hear if you do go to trial with one will think of is that this person is sloppy,dirty,etc.
Regardless, the final decision is yours. Think about it before you jump.
I do have people that will be a witness for me. At least one. I can probably get another IDK. I don't know if I can just get a signed paper with a written sworn statement and get that notarized, or if they have to come in person. I am not hiring a lawyer for this because I can not afford one for such a thing. I was not eating what was in my hand, and I was not in the kitchen. I am relying on the truth and the few things I mentioned earlier to get this thing dismissed (signed paper of a statement swearing that the witnesses did not see me eating, errors on the ticket, and a map of the restaurant showing where I was standing at the time).

Hmm, did not think of that. I think a map on paper will do fine though, but I might just get that too. This is all such a fucking ridiculous waste of time and taxpayers money!

This is exactly why they have regulations regarding where you can and can't eat food, where you can prep it etc.
