I wouldn't pay for a lawyer, but if the health inspector wants to take it to court, i would. Who knows, you might win the case.

So I checked for the price of the ticket online to see how much it was. It's not even in the system yet! I did get the number to his super and the super told me point blank he is a "by the book" kind of guy, and to take it to court and the judge will most likely dismiss it (direct words from the super). He told me to wait until next week and check online for the price (it could be fucking 3-400 bucks!!!).
I WILL NOT PAY this! I am going to the downtown office and set a court date on Monday. If anyone else gets in this situation please try to get a court date. I still have no idea why he was so shitty about it. I'll keep an update here as it goes.
P.S. I am not a cook, I bar tend where I work. I have an active LPN license but it is only good in OK. due to the fact I got it through a 2 year RN program. If I do not pass my upcoming NCLEX RN exam I will be moving to OKC to get an LPN job and continue to study for the next RN exam, I will take it until I pass it. I WILL PASS!
I do not plan on being in the bar/rest. biz past this year. Probably will be working as a nurse by midsummer. The end of May is my deadline for the next RN exam I have coming. Just waiting on my ATT.

I went to court today for the damn ticket. The prosecutor did not dismiss it. I have another court date and I can choose a trial by jury, or a bench trial. I did notice he put the wrong date on the ticket (It shows a date that is 5 months prior to me working there, and before it was even open). There is also a suffix on the end of my name on my license that he failed to put on the ticket. Could I possibly get this dismissed on these technicalities? This is the most ridiculous/ludicrous thing I have ever had to go through!

I would send you his number, but I believe he just had it changed last month.

Really confused here. I'm a barista and we also do a ton of paninis/soups/breakfasts at a counter that is literally touching the table where all the employees put drinks that they are drinking and have little snacks to munch on.
Never have had an issue apparently in 11 years of being an active store. I've only been there for around half a year but the owner is totally cool with this activity.
Why the fuck were you charged when it wasn't even in the kitchen!?!?!

Ive worked in the industry for about a decade, never heard of a fine to an employee. All fines here would be directed to the owner for failing to make sure an employee follows code.
A personal ticket is fucking stupid.
then again i know to bin anything im eating or drinking at first sign of an inspector.

This remains a mystery to me. I think he was just in a bad mood and wanted to fuck with me. My manager told me the other day that he is now going to retire. I hope he does not show up at the next court date.

I did throw it away as soon as he asked for my ID. I was not eating what was in my hand. I am thinking I should also get a statement and have it signed by some other people that said they would back me up on me not eating what was in my hand. He was a real dick about the whole thing. Should I get it notarized as well? Does anyone know if I can get it dismissed on the tech of the wrong date/incomplete name?

I'd like to give some input in this thread because In a few months I'll be an Occupational health and safety advisor, but the food health and safety portion that relates to restaurants is a totally different thing. I'd have to do another year of courses to become a health inspector and have knowledge about that.
Safety advisors, health inspectors and the like are always considered dicks, but there are a set of acts and regulations for every state/province/country that need to be followed to ensure the safety of workers and customers.
If anyone has had an experience with one, as I'm sure most of you have, know that they are not trying to tell you how to do your job or anything. They are simply trying to tell you what the law requires.

In the book it probably cites that it's considered unsanitary to eat in an area in which food is being prepared.

yeah... and actually investigate such claims and not just assume that someone who's holding a ramekin of soup in one's hand in a kitchen which prepares food, is eating it, and not just ... ya know.. preparing food.
