Well fuck! I was at work today and a health inspector came in. I had a small ramekin of soup in my hand and was not eating it. I was standing in the hallway outside of the kitchen. He immediately asked for my license. He recorded it. He left and the KM told me I need to be there tomorrow to sign something like a ticket of some kind.
I have been in the restaurant biz for 29 years and I have never seen this happen to anyone! Does anyone know what the fine might be? Can I dispute it with him before I sign whatever it is? Has this happened to anyone?

So I got a ticket which he claims is akin to a traffic ticket. I do not know the amount nor would he tell me. Said it could be anywhere between 1-2000.00. I have to wait until Monday morning to find any more info out. He would not back down on it. He also said he does not mind going to court. I have 29 years in the biz and have NEVER seen this happen to anyone! *SIGH* What a fucked way to start the year. I will no longer be working in the biz after July at the latest (that's the plan anyway). I have an active LPN license and will be putting it to use after my deadline to take the NCLEX RN in May.

LOL, Sorry did not consider people not knowing the official name of those little 2-4oz cups that hold to go sauces/dressings/spices. It has maybe 2-3 teaspoons of holding capacity. I had a plastic to go one, very small.

Lulz at the nazi health inspector. What a poon! I've worked in the biz for 6 years now and my GFs parents own a big restaraunt and have seen them do some stupid shit. They get all big-headed like a 10 year old who is a handed a police badge. I say fight it. If you weren't in the kitchen you weren't in the kitchen! Have any blue prints of the restaraunt? You can show him that you weren't in area labeled the kicthen. Also what about cameras? Any way to prove you weren't in there?

OP why are you cooking for a living when your an LPN? Just curious, also have you worked after getting your license, I almost got mine I just needed to finish my last semester but I dropped out for a few reasons...

Also that health inspector sounds like a total douche, it's pretty common for that kinda shit to go down in a kitchen and honestly what you did ain't shit compared to the horrors that are committed by a lot of other employees in soooo many other kitchens around the world.

Fight it. I would absolutely hate to eat from a kitchen where the cooks are not tasting there food. Not many kitchens I've worked in where this is not common practice.

Fuck that. Dont pay it, you didnt do a damn thing wrong. Don't submit to these assholes. Health inspectors get their jollies off to this kind of thing, even though they have an important job, they stretch it as far as they can. I'm sure he couldve walked around and found a ton of other violations that were actually more harmful to the public than you standing there with food in your hand.

So I checked for the price of the ticket online to see how much it was. It's not even in the system yet! I did get the number to his super and the super told me point blank he is a "by the book" kind of guy, and to take it to court and the judge will most likely dismiss it (direct words from the super). He told me to wait until next week and check online for the price (it could be fucking 3-400 bucks!!!).
I WILL NOT PAY this! I am going to the downtown office and set a court date on Monday. If anyone else gets in this situation please try to get a court date. I still have no idea why he was so shitty about it. I'll keep an update here as it goes.
P.S. I am not a cook, I bar tend where I work. I have an active LPN license but it is only good in OK. due to the fact I got it through a 2 year RN program. If I do not pass my upcoming NCLEX RN exam I will be moving to OKC to get an LPN job and continue to study for the next RN exam, I will take it until I pass it. I WILL PASS!
I do not plan on being in the bar/rest. biz past this year. Probably will be working as a nurse by midsummer. The end of May is my deadline for the next RN exam I have coming. Just waiting on my ATT.

I went to court today for the damn ticket. The prosecutor did not dismiss it. I have another court date and I can choose a trial by jury, or a bench trial. I did notice he put the wrong date on the ticket (It shows a date that is 5 months prior to me working there, and before it was even open). There is also a suffix on the end of my name on my license that he failed to put on the ticket. Could I possibly get this dismissed on these technicalities? This is the most ridiculous/ludicrous thing I have ever had to go through!

Really confused here. I'm a barista and we also do a ton of paninis/soups/breakfasts at a counter that is literally touching the table where all the employees put drinks that they are drinking and have little snacks to munch on.
Never have had an issue apparently in 11 years of being an active store. I've only been there for around half a year but the owner is totally cool with this activity.
Why the fuck were you charged when it wasn't even in the kitchen!?!?!

Ive worked in the industry for about a decade, never heard of a fine to an employee. All fines here would be directed to the owner for failing to make sure an employee follows code.
A personal ticket is fucking stupid.
then again i know to bin anything im eating or drinking at first sign of an inspector.

This remains a mystery to me. I think he was just in a bad mood and wanted to fuck with me. My manager told me the other day that he is now going to retire. I hope he does not show up at the next court date.

I'd like to give some input in this thread because In a few months I'll be an Occupational health and safety advisor, but the food health and safety portion that relates to restaurants is a totally different thing. I'd have to do another year of courses to become a health inspector and have knowledge about that.
Safety advisors, health inspectors and the like are always considered dicks, but there are a set of acts and regulations for every state/province/country that need to be followed to ensure the safety of workers and customers.
If anyone has had an experience with one, as I'm sure most of you have, know that they are not trying to tell you how to do your job or anything. They are simply trying to tell you what the law requires.

In the book it probably cites that it's considered unsanitary to eat in an area in which food is being prepared.

I was just outside of the kitchen area where "line" is that consists of the salad, sauté, grill, and so on. There is an alleyway that has the drink/coffee station and it is behind a wall that is the dining area. I am not saying he is just a dick for no reason, it just seems he was being a dick to me on that occasion. I was right by a trashcan and away from the drink/coffee area.
He actually left and gave me my license back. Then he returned the next day and proceeded to write me the ticket! I know he must have looked up my name and being a government official probably looked at all my history.
When I told him about me becoming a nurse and this is my last year of restaurants etc...he looked at me and said in a really weird tone while looking me straight in the eyes, "I know everything about you" very creepy! And then he made a comment of "I don't mind going to court at all". And was just really being a fucking prick to me for no reason other than he had the power to do so.
WTF am I supposed to think about that? This is really just such ludicrous BS! I am going to trial for a 2oz cup of some soup I was not even eating! A FUCKING TRIAL!!!

No he did not. When I talked to him the next day before he gave me the ticket I said to him point blank "you did not see me eating anything, I just had it in my hand". He replied "then what were you doing with it then?" I said I was checking it out for a guest (as I do all the soups almost everyday along with everyone else). The fact that he said "then what were you doing with it then" is an admission of him not seeing me eat it!
I can't even believe I am making this ridiculous post about the matter! FUCK!!!
Just wanted to warn other people in the biz that this could happen to you, and I will post results. Thanks for reading all of you!

I have a court date in 3 weeks. I can choose either a jury trial, or a bench one. LOL! I can see a jury trial now, "We the jury find the defendant"... Fucking hell!
I am getting a map of the restaurant and show where I was standing, a signed paper of people saying they did not see me eating anything either (I can get at least 2 people to do this), and the date I started working there to show that the date he wrote on the ticket is wrong. Armed with those 3 things and the truth I should win.

Joking aside, with a fine of just $340 like you say. It will cost you much more if you fight it (win or lose). For one thing lawyers don't come cheap and every time you go to court with or without a lawyer it will cost you time at work and even more money if you lose.
So unless, you have witnesses to back your side of things it may be very wise to just pay the fine,cut your losses and never let it happen again.
You can bet that 100% of society wants clean and well run kitchens without health violations. So all a judge and/or jury will hear if you do go to trial with one will think of is that this person is sloppy,dirty,etc.
Regardless, the final decision is yours. Think about it before you jump.
I do have people that will be a witness for me. At least one. I can probably get another IDK. I don't know if I can just get a signed paper with a written sworn statement and get that notarized, or if they have to come in person. I am not hiring a lawyer for this because I can not afford one for such a thing. I was not eating what was in my hand, and I was not in the kitchen. I am relying on the truth and the few things I mentioned earlier to get this thing dismissed (signed paper of a statement swearing that the witnesses did not see me eating, errors on the ticket, and a map of the restaurant showing where I was standing at the time).

I talked to a lawyer who comes into one of the restaurants I work, he does not do criminal law but suggested I take a jury trial instead of a bench one.

Yesterday I go in to work, my KM is eating a steak in the office, he says "I would give you a bite but you might get arrested" ha ha very funny MF! Then I say "I have a fucking jury trial for that ticket!" and the guy that gave me the ticket is all of a sudden right behind me and says "I love jury trials!" WTF!!! This guy is a fucker! My manager just looked at me and freaked!
I the proceeded to tell the guy how ludicrous this is, that he should not show up so it will get thrown out, and how much of an inconvenience this caused me especially since I am studying for a state boards test for nursing right now. He then bragged about how he "just wrote 22 more tickets today". FUCKER!
He did tell me that off the record I could call and ask for deferred adjudication. He also said that he would not proceed with a trial and call it off, BUT only if they verbally ask him to do so! This guy is a real fuck. I am very curious as to why he is such a fucker about this. I am wasting too much energy on this and at a time when I need to focus on something else. *SIGH*
At the end of the night my KM was like WTF? I had no idea he was standing there! I said I know! What a freak! Court date is on Feb 26th, 4 days after my B-day.

I know the rules/law. I was not eating what I had in my hands. I have 30 years in the biz and have NEVER seen or heard of this happening. He must generate a lot of money for the city and I hope this does not make a difference in the outcome. It boils down to me asking him point blank in a court of law if he actually saw me eating/take a bit of what I had in hand. I did not, and he knows I did not. If he lies I don't know what will happen! If he is as by the book and honest as he seems to be, he will not lie (if it comes to a court trial).   What a waste of everyone's time, energy, and money. Aint nobody got no time for that! (apparently he does though)

I did not have a bowl, it was a small 2oz ramekin. I was not in the kitchen food prep/counter area, I was not eating it. I check the quality of the soups for the guests all the time. I also bring them samples in those little ramekins. This really is a freak show! It comes down to me asking him point blank if he actually saw me put a spoonful of the item in my hand into my mouth. He did not because I did not. Intent is not on trial here. It is the truth that is on trial. The ticket states "eating in the kitchen". I was not doing either.
