What should I do about this?
    #19278075 - 12/15/13 07:39 AM (10 years, 1 month ago)

Hey All. I was advised by a friend to come to this community and ask for advice on my dilemma..

A few days ago (on friday the 13th) I was driving home to Portland Oregon (Clackamas County) from Seattle after driving there over eight hours and back that day for an all day business meeting. I was about three miles away from home, and it was pretty busy on the road - cars in front of me, cars to the side of me, and the car behind me happened to be a sheriff in a Charger who had a laser that he used to measure my speed. He proceeded to turn on his lights and pull me over. At this point I started panicking and figured I have to pull over as quickly as possible so I pulled over to the left and waited with my hands on the steering wheel - respectfully.

He comes up to the window and asks me why I was going 74 in a 55mph zone (when obviously this was the pace of everybody driving on the road, including him) - to which I had a hard time replying because I was in minor shock since I had gotten two other speeding tickets (total flukes) earlier this year (after five years of clean driving with no problems at all.) He also asked me why I pulled over to the left and not the right - to which I replied that I figured I had to pull over immediately and not risk being accused of trying to outrun a cop if I had tried to merge to the right (which was being blocked by other vehicles cause the road was busy at that time.) To the speeding question I replied that I didnt realize I was going that fast and he proceeds to ask me for my ID. At this point he takes the ID and tells me to pull out my insurance and registration and have it ready for when he comes back from his car. He goes to his car and I get my papers ready.. when he comes back he takes my insurance/registration, looks at it, hands it back to me, then hands me a ticket with a $160 ticket for speeding on a free way, and a $260 ticket for not yielding to an emergency vehicle.. He hands me the ticket, shows me my court date, then tells me to pull out carefully.. All this happened within four minutes of pulling me over..

I read that in Oregon your license is suspended for 30 days if you get four violations in 24 months. Can anyone validate this?

Is there anything I can do to defend myself and not make it so my license is suspended if I end up getting convicted of these citations?

I would go to court about it and talk to the judge or solicitor. You could argue that everyone else was going the same speed and possibly get your sentence reduced. I got a $250 speeding ticket where I was going 19mph over the speed limit reduced down to a warning when I gave the solicitor a sob story about me being in a hurry to get to work on time. It was the truth, but still a sob story nonetheless.

Also wtf, not yielding to an emergency vehicle? You most certainly did..even if you did pull over to the left,  rather than the right. I would mention that in court too, because that sounds like a load of bullshit.

learn to fight.
learn how to use a weapon, or preferably, several.
keep said weapon(s) on or near your person at all times.

Funny thing is I was pulled over one time and as soon as i was pulling into a parking lot I was reaching over to the glove box to get my insurance and have it ready for the fine officer. When he came up to my window he said "I saw you reach over and put a gun under your seat! Let us search your car", then proceeded to convince me to let him search. At one point he even threaded to pull me out of the car and put a gun to my head because I started reaching over again to show him that the insurance was all I was reaching for. I kept saying no to a search and sure enough he got another cop over who also started talking to me and attempting to convince me. I ended up letting them search me and they found nothing in my car but cannabis.. for which I have a card..

I have never shot a gun in my life..

sigh.

And thanks for the input Ballerium.

they could smell the fear on you.
they have authority over you because you fear them, because you give them the power to change your thought process.

and it's not just cops:
you don't get out of bed because your alarm physically forces you to, you have given the alarm the authority to tell you when you will stop sleeping.

Man you have some solid points. I was pretty afraid at the moment that it happened, but it was because all I could think about was getting another ticket on top of the others, and that added to further stress and fear. I can see your alarm clock analogy.. i actually took your advice and didn't set my alarm clock, trusting that I would wake up early enough to have time to get ready for work because I worked 7 hours after I got off a graveyard - and sure enough I woke up a solid hour early.

You are a wise poster.

Yeah that's bullshit. From what you're telling us, regardless of what side of the road you pulled off to, you DID in fact, yield to an 'emergency' vehicle. Fuck pigs.

You have rights. You need to use them. Do not let authority push you over.

"Okay, do you mind if we look around?" "You dont have any guns, knives, drugs etc in your vehicle?" etc etc etc

Your response is. "Sir/ma'am I dont give consent for a search. I am using my rights to not answer any questions" Cause you dont have to talk to the cops or answer any bullshit questions they have. Many people will probably say "oh why dont you just talk to them and they'll leave you alone." this is not the case. you have rights, exercise them.

It sounds like you are terrible at dealing with the police. You can't let them rattle you like that.
Seems like that failure to yield ticket is an unsubtle message that the cop just wanted you to get the fuck out of his way, but then you proceeded to act like you'd done something wrong, so he dutifully agreed.

Relax man, you're just a citizen going about your business. Don't go frantically screeching to a stop and digging through your glove box. Lazily pull over, keep your hands on the wheel, and let him tell you you've got a broken taillight.

Example of Police lying and abusing power to push over citizens.
