Okay so lets start this off by saying that I have been arrested for pot but that is it. It was also a misdemeanor charge. My buddy gave me this laptop a couple of months back and I had been using it. I used it for about 3 months and no problems. So two days ago, the police came to my mothers work and asked about the laptop, said it was stolen and asked if i would turn it in. I took it up to the police and they arrested me for possession of stolen property 2nd degree felony charge. I am 19 years old and want to join the military. i was wondering if anyone could help me out so I can kind of expect what is going to happpen when I go to court..Thanks.

Also, what do you mean he 'gave' you a laptop? You didnt think it was weird he just gave you a laptop without buying it off him or any sort of exchange?

This. And in the meantime, you could look for Enlil's "ask a defense attorney" thread and explain your situation there to get a better idea of what you're dealing with. In future it might be a good idea to ask more questions when you're offered something like this. You also have to wonder how the police figured out that you had it, seems likely that this "friend" sold you out.

Lol no.. Military would be a good choice.. Unless you're going to jail (highly doubt it) military would be a good idea.
Like mentioned earlier, get a lawyer. You shouldn't be in any trouble because you had no 'intent' of committing a crime. If anything, maybe your friend (how much of a friend is this friend) should be the one getting in trouble.

. I am getting a lawyer, but you don't think I could get a waiver from a recruiter? I have family in the Forces too. Do you think that could help? I am also positive this person told the police that he gave it to me, and he is no longer my friend. Where can i find this threaad?

Thats what I was thinking I was just going to wait till everything blows over. There is a good chance that i will get my charges dropped because I came in by myself and turned it in. Who knows though cops are tricky bitches.

Stick to your story and do it without a shred of apprehension. This can go fine but you need to make sure they realize it's a misunderstanding. You will be fine, the more you worry the more you are going to be detrimental. Good luck dude.

Yeah I mean it probably helps that he freely chose to bring it in to the police station. Those are the actions of someone who had no idea that the thing was stolen, and wanted to make things right as soon as they found out. He could just as easily have ditched the evidence and denied everything, and would have nothing but the "friend's" word if they came looking for it and found nothing. Instead, the OP did the right thing and the original owner will be getting their property back.

If you're super cooperative, you may cooperate yourself right into a jail cell. Listen to whatever your lawyer says. But if this supposed friend pointed the cops to you, and you had the laptop, then good luck proving this friend had anything to do with it at all. At this point there's no evidence that points to anyone but OP, really.

Wrong. All he did was maintain the chain of evidence showing he was in possession of stolen property. In my opinion, cops are like anybody else. Why do any extra work. They've made an arrest. Case closed The only way he gets out of this is if somebody else in the system, like the prosecutor or judge doesn't agree that they've arrested the right person... And they don't want to do extra work either.

No my friend has 12 felonies right now for burgerlary and other theft charges. they arrested him 2 hours before they talked to my mom. But they said they had been tracking it for months to my house. They just walked inside his house and didnt even come near my house though. I don't know its just a really sketchy situation...

If your friend already has 12 felonies for burglary and theft why in the hell would you take a free computer from him?

At this point it's up to the court, and they may (or may not) decide to be more lenient since he "did the right thing." The police obviously have already decided to charge him. Ideally he would have talked to a lawyer first to figure out how best to proceed, but he didn't.

I'm making a huge assumption, but I have a pretty good hunch OP knew the laptop was stolen. He probably didn't realize he would get popped using it. It was his friend that has multiple charges of burglary, and he's giving away a free laptop?

You could have avoided avoided the whole situation and not turned in your stolen property... You hade it and they said it was stolen so taking it in was a crime. Same thing happened to me and I did the pre trial adjudication and pain my 1500 and nothing ever happened...
