Former narcotics task force director indicted [KY]

LEXINGTON | Federal officials announced late Thursday the former executive director of the Buffalo Trace/Gateway Area Narcotics Task Force has been indicted for allegedly stealing public funds.

The case went before a federal grand jury in Lexington, Thursday. The indictment was announced jointly by Kerry B. Harvey, U.S. Attorney for the Eastern District of Kentucky, and Perrye Turner, Special Agent in Charge, FBI.

According to the indictment, "in the two and half year period that 52 year-old Timothy George Fegan of Germantown, served as the Task Force’s director, he wrongfully appropriated thousands of dollars in cash that was in the care, custody, and control of the Task Force." The indictment alleges Fegan took cash proceeds seized by Task Force agents during drug investigations and money kept on hand by the agency to perform controlled drug buys.

Fegan served as executive director from April 2010 to November 2012. He tendered his resignation on Nov. 6, and then was immediately terminated from his position by the Board of Directors on Nov. 7.  The actions came about after a spot audit of the 2012 financials by Mason County Sheriff Patrick Boggs in October, after he was named chairman of the board of directors.

A former officer with the Maysville Police Department, Fegan had been with the Task Force for 15 years.

The Buffalo Trace/Gateway Area Narcotics Task Force was organized by several county and city governments and was responsible for the investigation of drug crimes in various northern and eastern Kentucky counties. The Task Force was funded by federal and state grants and funds contributed by the county and city governments that formed it. Maysville served as the base of operations for the Task Force.

In March 2013, the board of directors voted to dissolve the agency, effective June 30, 2013.

The investigation preceding the indictment was conducted by the FBI and the Kentucky State Police. The indictment was presented to the grand jury by Assistant U.S. Attorney Andrew T. Boone.

According to officials at Harvey's office, a date for Fegan to appear in court has not yet been scheduled. He faces up to 10 years in prison and a maximum fine of $250,000 for each charge. However, any sentence following a conviction would be imposed by the court after consideration of the U.S. Sentencing Guidelines and the federal statutes.
