Unarmed Man Charged With Assault After NYPD Shoots 2 Bystanders

For the crime of being difficult to shoot, a Manhattan grand jury has charged an unarmed, mentally unstable man with assault after police officers opened fire at him, missed, and wounded two bystanders as the man was blocking traffic last September in Times Square.

On September 14, Glenn Broadnax walked into the crowded streets of Times Square and jumped in front of several oncoming cars, apparently in an attempt to get run over. NYPD officers tried to take the 250-lb Broadnax into custody, but he resisted and, according to police, reached into his pocket. Two NYPD officers thought he might be reaching for a gun, and, in order to protect the thousands of innocent bystanders in Times Square, fired their service weapons at Broadnax. But the officers missed and wounded two innocent bystanders instead. Broadnax was eventually subdued with a Taser.

At first, police charged Broadnax with menacing, drug possession, and resisting arrest, but the Manhattan District Attorney pushed for assault charges because Broadnax "recklessly engaged in conduct which created a grave risk of death."

"The defendant is the one that created the situation that injured innocent bystanders," assistant district attorney, Shannon Lucey, told the New York Times.

That's one way to look at it. Here's another, from Mariann Wang, the lawyer representing one of the woman shot by the NYPD. "It's an incredibly unfortunate use of prosecutorial discretion to be prosecuting a man who didn't even injure my client," Wang said. "It's the police who injured my client."

Broadnax, who, at the time of the incident, believed he was talking to dead relatives, according to the statement he gave police, is being held on $100,000 bail and faces a maximum sentence of 25 years. "Mr. Broadnax never imagined his behavior would ever cause the police to shoot at him," Rigodis Appling, his attorney, said, adding that a disoriented Broadnax was reaching for his wallet, not a gun, when the officers opened fire.

"The only thing the individual had on his person was a wallet which was recovered from his right rear pocket," Police Commissioner Ray Kelly told reporters after the shooting.

The two officers have been placed on administrative leave pending separate investigations from the NYPD and the District Attorney.

So high profile nobody heard of it.  It also seems this is to a specific Oklahoma statute, so unless you can prove this is a common charge, then I'm calling B.S.

Are you incapable of reading? If someone is "mentally unstable" as stated in the article there is a large chance that they won't be thinking properly.. Not to mention that if someone just tried to get hit by a vehicle the fact they aren't all there, should be readily apparent.

It didn't happen in NYC, and NYC is totally different than other cities.  NYC has an exceptionally large # of mentally unstable people, and you literally see crazy people on every other block.  What this guy did happens every other day in NYC, the cops just fucked up and went crazy.  He should be in a mental health hospital, but stupid pigs were trigger happy.

Cops in NYC vary from really laid back don't give a shit types, to incompetent assholes which is what happens when you have 35k cops, many of which are 140 pounds soaking wet.  Its like they hire anyone that walks in the door...

i think it's reasonable to shoot someone who is resisting arrest, and then reaches for something in their pocket.


it's also reasonable to shoot someone who is breaking and entering your home.


now if i was shooting my gun in self defense, and i missed and hit my neighbor, would i get a paid vacation and the charges put only on the intruder?

nope.


but the cops can miss, get paid vacations, and blame the man resisting arrest for their incompetency with their firearms

It's reasonable depending on the circumstances. But as is often the case, police jump at the chance to use again whether or not its justified.

If he just tried to kill himself then he obviously is having mental issues.. That in and of itself isn't reason to start shooting.. Pulling something out of his pocket might be.. But honestly that milli second it takes to even get a tiny glimpse that it might be a gun good make every big of difference.. Some people might say thats too long, well it is a hell of a lot safer then shooting at someone that MIGHT be pulling out a gun (without seeing anything), and shooting a bunch of innocent people...

But yeah, essentially other then what I said, I agree with you.. The cops are retarded for firing there weapons in a crowded area... The district attorney is even worse for even trying to do this charge... I highly doubt it will walk and either way cost tax payers money for something that is going to cost money anyways when the city pays out to the wounded civilians.
