Cops searched my car & of course I had weed, HELP!!

I'm gonna make this quick & spare you with details. I got pulled over & the cop smelled weed, then he searched my car. Had a box with two pipes, grinder with weed, several cigarillos, and if I'm not mistaken it was 3 or 4 grams in the box. I got a misdemeanor citation. Court date in January.
Am I going to jail y'all?
Will this be on my record permanently?
Advice from some one here who has ever gotten caught? (BTW, I live in Memphis, TN; if anybody is familiar with our laws, or lives here too.)

And yes, if anyone asks, I've been to the "ask an attorney" thread. I just wanted to get opinions from someone else who has personally gone through this or knows someone.

You probably wont go to jail for a couple grams of weed and some paraphanalia . Probably just get probation and maybe restricted/suspended license for a few months plus some fines.
Whatever happens just show up to your court date with some cash for fines, the judge will like that and may be lenient. In the end all they want is your money.

I reposted this from the original thread:
Quote:
HappyHooligan said: I was questioned and asked to give up names & numbers of people who sell weed. They said "help us out & we'll help you." "we can easily send your papers to a higher power" isn't that like a threat? I wanted to be quiet, but I was so nervous I forgot I had the right to remain silent. I have a panic disorder. Can I use that in court? They made me feel threaten? They never told me I could be silent.
First of all, you're facing two misdemeanors at most (Simple possession, and possession of drug paraphernalia). The fact that you didn't even get booked into jail should have been a clue that this isn't very serious. You really shouldn't have given anyone up over this. That was very dumb and irresponsible with other people's LIVES! These are not even serious charges at all. Driving around in Tennessee with unnecessary paraphernalia in a box as if it's California and you have a med card is dumb enough, but then snitching over a simple possession charge and maybe a paraphernalia charge? You should move out of Memphis ASAP and never come back. I feel so bad for the people who were dumb enough to deal with you.

Dude get off my thread. I already told you on the other thread..
You don't even know WHAT I told the police. I never snitched, I never told them any names, numbers, places, any connections, so fucking bye(again).

Nah, you hadn't told me anything yet when I posted that, check the time stamps. To me it sounded like that's what you were saying you did, straight out. I'm not buying it still, personally.

You, sir, need a lawyer. Maybe start here? http://lawyers.norml.org/tennessee
Here are the penalties. Not sure how the courts are in Tennessee, but I'd guess that for a first offense you'd get off without jail time... but they'll want their pound of flesh. Get ready to fork over some ca$h. http://norml.org/laws/item/tennessee-penalties-2
Questions:
1. Is this your first offense? 2. Are you a minor? 3. What are the charges? Did they hit you with a para charge as well, or any others? 4. Did they tow your car?

I'm not resisting, but I don't consent to any searches.

You're most likely just gonna get probation and a fine. Maybe even expungement, but you may need a lawyer for that.

Any competent Public Defender can most likely get these charges reduced/dropped with a possibility of expungement.
If you can't get the charges expunged, you very well may be able to get them dropped after a diversion program.
I know it sounds like bullshit (and it most definitely is), but if you are able to, it would go a LONG way to voluntarily seek "drug counseling" before you even go to court.
Don't take the initial deal that the prosecutor offers you, get some real legal advice from a defense attorney (whether a PD, or someone you consult).
Lastly, stop driving around in a car that smells like weed.

Bro, to be fair, your wording in that other post does very much seem to imply that's what you meant.
Anyway... no one can really tell you for sure. Being a first time offender (I assume?) and having no record can only help you. As would the fact that it's a small amount, and I imagine you were relatively polite and cooperative with the police.
Generally speaking, in most places, getting busted with a very small amount of pot, with no criminal record, you probably will not go to jail. I base this on stuff I read, and personal experience. But I live in a far more liberal state than TN.
Being caught with only about 4-5 grams, and no criminal record, I plead no contest, and had to take a drug class, as well as like 6 months probation. I had to pay (way too much) for the drug class, as well as for the probation. which was the worst part of it, for me, at the time, as I didn't have much extra money and the whole thing was quite a burden on me. Far preferable to jail, of course.
And while the drug class cost way too much for just a few hours of lecture (the company that puts those on must make bank)... it actually wasn't a terrible experience. There were only a couple classes, and the entire last class was spent, with our teacher explaining to us how the war on drugs is a sham and is harmful to society, how the justice system is flawed, and how the real kingpins tend to get away with shit, while the usually poverty-stricken low-level dealers and buyers get fucked. It was really amusing to hear a woman whose job was essentially to say "drugs are bad, m'kay?" speak like a proponent of legalization.
That alone was almost worth the price of admission.
Good luck, OP. Be respectful in court. Be gainfully employed, or planning to go to school. These things can only help you.

Yea, I'm a girl (I just wanted to point that out because you called me bro) I am in college & I do have a job. I honestly don't care about paying a fine or being on probation, I literally just don't want to go to jail lol. This was my first offense & I was very polite to the officers. Thank you for replying to my post

You will be cool, No big deal OP. Its all about the money. So they'll slap you with like a 500 to 600 dollar fine with court cost ect. They might you like 6 month probation might make you take drug classes to get rid of the charge. But I;d keep the charge its not like it will affect a job or any thing its a misdamenaer. On your citation is it Mandatory that you appear in court? or can you just pay a fine.

1. Get a lawyer
2. Tell the lawyer that the box containing all that stuff was not yours and you were unaware that a friend had inadvertently left it there.
Explain to the Lawyer that having this on your record would ruin you life as you wanted to be a doctor, a policeman, or some other profession that was noble and saintly.
mention that you would be willing to pay any amount of money to have this terrible mistake just go away.
Also mention to him that you have been under terrible stress as you and your wife ( girlfriend) etc, tragically lost your child.
The lawyer will pat you on the back, ask you for about two thousand dollars cash up front and tell you that he will solve your problems.
3. Give him the money.
relax.
When you got to court you will discover that you charges have been withdrawn and you will get to walk away like it never happened.
This my friend is how the criminal justice system works in my humble opinion.
The lawyer is the con man

and the cop and courts are the strong man.

Are you getting student loans? Cause in Michigan if you get caught you loose all connection to student loans.
If you snitch it will come back to you. Worse then a couple grams would get you

Go sit in court for awhile (it's free!). You'll see an entire parade of weed, alcohol (MIP), and DUI cases. Then you'll know exactly what the sentence is and how to handle yourself when it's your turn.
When you see the 100 or so cases a day they do of these charges you'll know what's up and be reassured. Never rat anyone out over misdemeanor charges!
