I just don't think this guy understands that the senate was designed to produce gridlock. The senate acts as a check to the power of the executive.

Well, not anymore I guess. I suppose the OP is ok with this because it is "his" party that is making this unprecedented power grab. Little does the op realize that the leadership of "his" party doesn't give a flying bleep about people like him. Such is the folly of the two party system, it has degenerated into something like a good damn sports rivalry. George Washington was right. We are screwed.

Obama was rated the most liberal Senator.  Republicans were elected to stop him.  Opposing Obama is their electoral duty to their constituents and his race is a smoke screen for assholes who cannot come to grips with the liberal cunt's grotesque incompetence.

The real problem is the lifetime tenure for district court judges.  I understand the logic for the SCOTUS, but I definitely don't for trial judges.

  Whats the difference between a 'trial judge' as opposed to another kind of judge? :confused:

District judges are trial judges.  In the federal system, a district court is a trial level court...basically, the nuts and bolts court where shit gets done.  Lawsuits are filed there.  Trials happen there.  Criminal cases are brought there, etc.  Above the district courts are the Circuit Courts of Appeal.  There are 13 circuit courts and they hear appeals from the district courts in that circuit's geographic region.  Circuit courts are appellate courts.  They don't hold trials.  They only hear appeals.  Above the circuit courts is the SCOTUS...you already know about that court.  It also doesn't hold trials (except in exceptional cases)...it is an appellate court as well.

The reason the SCOTUS has lifetime tenure is so that the judges don't have to worry about the popularity of their decisions when rendering opinions about our Constitution(which is specifically designed NOT to be easily changed)

Trial courts, on the other hand, don't make binding precedent, so there's no need for them to have that amount of judicial independence. They SHOULD be more accountable to the people.

i thought a decision by any court could become a precendent? 


Also, so if a case is heard in an appelate court, and they say 'well, this guy was convicted wrongly because they used tainted evidence' or something like that, what happens then?  Say if they overturn the conviction, does the lower court try him again?

Possibly.  The appellate court could just dismiss the case outright, or they could alter the judgment, depending on the circumstances.

And no, a trial court's decision isn't precedential over any other court.  The only precedential effect is has is under the "law of the case doctrine" wherein a court's decision is binding on that same court for future decisions in that same case.

Even a circuit court of appeals decision is only binding on courts in that circuit.  It isn't even binding on state courts unless it is based on federal law or the constitution.
