Almost two-thirds of Americans think it would be unacceptable for a company to fire an employee for off-the-clock marijuana use in states where using marijuana is legal, according to a new HuffPost/YouGov poll -- the same percentage that said it would be unacceptable to fire an employee for off-hours drinking.

According to the new poll, a majority of Americans -- 64 percent to 22 percent -- think that if marijuana were to be legalized in their state, it would be unacceptable for a company to fire an employee for smoking it during his or her free time.

That's an identical ratio to the response for whether or not it would be unacceptable for a company to fire an employee for after-hours drinking, with 64 percent saying it would be unacceptable, compared to 22 percent who found it acceptable.

But when simply asked whether it would be unacceptable for a company to fire an employee for smoking marijuana off the clock -- excluding the question of whether or not marijuana use was legal -- a 45-percent plurality of respondents said it would be unacceptable, compared to 32 percent who said it would be acceptable.

Republicans in the poll were most likely to be swayed by whether or not using the drug was legal. Given the status quo, 41 percent of Republicans said that it would be acceptable for an employer to fire someone for using marijuana, compared to 32 percent who said it would not be acceptable. But if using marijuana were legal, a majority of Republicans -- 62 percent to 27 percent -- said it would be unacceptable to fire an employee for marijuana use.

Respondents under age 30 were the most likely to say marijuana use off the job should not be a firing offense, regardless of whether or not marijuana use was legalized. Fifty-one percent of this group said that it's unacceptable to fire someone for pot smoking, while 30 percent said it's acceptable.

But if using marijuana were legal, a majority of respondents in all age categories said that it would be unacceptable to fire someone for smoking it. The 45-to-64-year-old age group was the most likely to say such a firing would be unacceptable, at 73 percent, compared to the 18 percent of that age group who disagreed.

The HuffPost/YouGov poll was conducted Oct. 31-Nov. 1 among 1,000 U.S. adults using a sample selected from YouGov's opt-in online panel to match the demographics and other characteristics of the adult U.S. population. Factors considered include age, race, gender, education, employment, income, marital status, number of children, voter registration, time and location of Internet access, interest in politics, religion and church attendance.

I don't think it's acceptable for people in certain lines of work to smoke. I wouldn't want my surgeon to be a pothead or the guy flying the plane I'm in.

Too-big-to-fail companies collect tax benefits, in excess of what they pay quota cases.

Rehab and related counseling can make you a quota case, if you say you need help.

Contrary to common opinion, it will not necessarily hurt you, if you disclose your status as a drug user.

In fact, in some places, it is your only hope of being retained.

All things being equal, the employer can promote or fire someone, for reasons called, "intangibles." Many applications or contracts say that you can fired, at any time, and for no reason.

I have left on good terms, but later paid a friendly visit, to find someone of my same overall appearance, like I had been replaced by a double. I visited similar businesses, on the same shift, found the same demographic ratio on work crews, around town.

Anyone who says that quotas and demographics are not factors is either naive or covering for nepotism and wrongful termination.

Civil society should be openly skeptical of the color of authority and airs of meritocracy, especially when the workplace is a dependent of the state.

But, the nature of the discussion shows that the public is oblivious to real world policies.

I haven't vaped in years by now, but I know for a fact that marijuana use would end up getting me negative attention at work, but only through poorer performance - given the way that it disrupts my short term memory, concentration, and overall I feel slower, spacey and somewhat tense. Escaping work isn't in my interests; I work with a lot of real time data and many different people every day, and am also responsible for direction/instruction of volunteers and LAs. And I enjoy it.

Some people have jobs that can more readily benefit from the use of cannabis or psychedelics, like production or software engineering.

Are unions not actually supposed to be as common or helpful as they've been for me?

Some union contracts typically include language stating that intangible, sudden termination or unfair disciplinary action is illegal.

A very simplistic hardline coming from you there. I don't know what exactly where to draw the line as to what would be acceptable and what would not be acceptable, but there are a lot of questions that need to be considered.

Surgeons in group practice often work weeks/months in a row followed by an often multi-week long vacation (12-16 weeks of vacation a year, insanely demanding work weeks when working). What they do on an extended vacation might impact them differently than what a 9 to 5 Monday through Friday doctor would do on their regular weekends off.

A doctor might have sprained their ankle. Might the pain distract them in their care of you? Could they take medication for a limited time to aid in recovery and to make them be able to work through some of it? Would they take a narcotic or an anti-inflammatory. Some anti-inflammatories can give you a head ache as a side effect just as much as a narcotic can make you sleepy or unfocused. Could they take any number of drugs for other illnesses that may incidentally affect their mentation including something like chemotherapy? What is the level of such medication that would be appropriate? Who draws the line? The doctor in question or their peers?

A doctor who is exceptionally skilled but slightly altered may have a better patient outcomes, than a doctor who got accepted in to med school on affirmative action and barely squeaked by.  Would you rather have a doctor on a mild stimulant that one who is not after they are called in in the middle of the night and still groggy? Would you want to die on the table because they feel a little tired? They just can't not come in for every little boo-boo that might happen to them.

Do you realize that bomber pilots and crews have Go Pills (pharmaceutical amphetamines/stimulants) and No Go pills (temazepam/sleeping pills). The government does not risk a billion dollar airplane going on an often greater than 24 hour mission into the care of operators whom the mission requires be pushed beyond their natural limits.

I think the question at play here is the level of use and setting of use, unique to each drug. There will be need for supervision and people should not be self-medicating. There are a lot of tricks that do not involve medication that are obviously needed to be used by these professions to get themselves sharp, focused and up to speed. Maybe employing organizations or the community at large would be better served through sending employees to marijuana or alcohol treatment instead of firing them outright. I do not feel the situation is as black and white as you think.
