Annie Dookhan’s attorney pushes for 1-year sentence, Ex-drug lab chemist says her life has been destroyed

Annie Dookhan, the former chemist at the state lab whose alleged mishandling of evidence has thrown the state’s criminal justice into turmoil, made a series of “tragic and terrible mistakes,” her defense attorney said today in a hearing in Suffolk Superior Court.

Attorney Nicolas Gordon argued for a one-year prison sentence, far less than the 5 to 7 years that the attorney general’s office is seeking.

“There is absolutely no malicious or black-hearted or evil criminal intent to be found anywhere in this case,” Gordon told Superior Court Judge Carol Ball.

Assistant Attorney General Anne Kaczmarek argued that because of Dookhan’s “self-serving and selfish” intent and the widespread impact of her actions, she should get the longer sentence. She said Dookhan’s actions had weakened and created mistrust of the criminal justice system, and cost taxpayers hundreds of millions of dollars to rectify.
 
Prosecutors are also seeking five years of probation for Dookhan, who attended today’s hearing, along with her father, and at one point broke into tears.

Ball said she would listen to the lawyers’ arguments and announce at the end of next week the maximum sentence that she would impose, if Dookhan decides to plead guilty.

Prosecutors have said Dookhan deliberately tampered with evidence so that substances would test positive for drugs. A review conducted at the request of Governor Deval Patrick found that her actions may have tainted more than 40,000 cases.

Hundreds of people have been released from state prisons and county jails due to questions about the evidence that was used to arrest or convict them. A state chemist’s certification that a substance seized by police is actually illegal drugs is a key foundation of a drug trial.

“The extraordinary damage is just incalculable,” Judge Ball said during the hearing.

Arguing for the more lenient sentence, Gordon said Dookhan was “a shell of her former self” whose “life has been destroyed.”

He said her husband has left her and is living with another woman and she has a 7-year-old disabled son with a medical condition. Dookhan is the center of the boy’s universe and she fears being separated from him, Gordon said. Tears rolled down Dookhan’s face as the lawyer spoke about her relationship with her son.

Gordon also argued that her motive had solely been to be a sterling employee.

“Her motivation is to be the hardest working and most prolific and most productive chemist that she can possibly be, and that’s how this whole mess begins,” he said. He described her actions as a “series of tragic and terrible mistakes.”

Judge Ball said she held the normally private lobby conference in public because “the events that brought us all here today have had such a serious impact on the criminal justice system” that it was important that everything about the case be “open and up front.”

Wow.  She lies about lab results, which are insanely expensive to dispute, in over 40,000 cases.  Hundreds of people were let out of jail, who she put there for no reason.  The article says this will costs hundred of millions to fix.  And now she's asking for leniency because this has ruined her life. :wtfsonic:

Also, how is she only facing 5 - 7 years for this?

If she knowingly falsified lab reports, this bitch should be getting way more than 5-7 years.  Hell, if they're going to send people away for 40+ years for a small amount of crack, then she should be getting life. 

How can someone say there was no evil intent if she potentially knowingly sent innocent people to prison?  Falsifying lab reports doesn't make you a sterling employee, doing your job properly does.  Being a good chemist means you report your actual findings, regardless of whether they further your cause or not. 

The chemistry must be respected.

I wonder how many times this has happened in other places. It really undermines existing support for the war on drugs, and proves what the rest of us already knew: every facet of the drug war is corrupt a hell, their only care is money.

The turmoil in her life is but a small taste of the harm she has done upon others.
If she spent the rest of her life in prison, it wouldn't be enough - it would just be the slightest taste of her own medicine.
Her husband left her? Well, I wonder how many relationships she's shattered. I wonder how many marriages, how many careers she's wrecked.

She should serve time equal to the served prison time of everyone who was convicted based on her fabricated evidence. I'm guessing that would amount to hundreds, if not thousands of years in prison.

I know for a fact first hand they lie about drug test results in Oregon. I told them what I wanted them to know, pissed for them, then they stored it for over a year. when the court ordered the urine actually be tested rather than just my confession of thc and lorazepam, the results came back with just those two drugs. I was full of opiates and other benzos, and I actually had a little alcohol in my system still. at least their lies worked in my favor in this case.

Locking her up solves nothing but validates our broken prison system as a solution to more complicated problems.
10 to life community service seems like a good place to start, as does a real investigation into how she was able to do so much damage.  Multiple people deserve to be charged over this.

It's extremely telling that the courts are worried more about the image of the Criminal justice system and the money she cost them than locking up innocent people for harmless crimes.  It's almost like they still assume most people were guilty and are being let out on technicalities and not that evidence was fabricated against them and they never had a chance at a fair trial to begin with.

Definitely intended, but I also truly feel that way.  As a scientist, it is your duty to report accurate findings regardless of personal bias.  It's sickening that she would falsify reports such as these, particularly when so much is on the line for so many people.  It makes me question what were her motivations for doing these things.  I can't imagine her supervisor is concerned with how many results are positive and how many are negative (at least they really *shouldn't* be).

Yea, I also was very curious about her motives. It definitely makes you think its her own form of vigilante justice. She likely knows the chemistry of half-lives and such and knows that the hard drugs are out of your system in just a few days. Maybe she thought if somebody was accused it was probably because they were guilty and should be locked up, regardless of what an admittedly poor way of determining drug use says.

Not saying I give a shit what her motive is, she should spend the rest of her life rotting away in prison for her crimes. She should be charged with every count of tampering with evidence and serve each sentence consecutively. Just wondering what would make somebody do something like this

That's what I'm struggling the most with as well.  She says she wanted to just find a bunch of people guilty of drug charges to advance her career, but like you said, I don't buy that.  How could the percentage of cases actually involving drugs ever figure into her compensation or performance review?  She has no control over that.  Seriously, if there's one thing a drug testing chemist would NOT have control over, it's the percentage of samples that test positive.  Tying review scores or compensation to such a thing could never possibly make any sense.

One thing I've learned in my short time on this earth is that you really should not expect everything to make sense.  For example (and granted, this is not involving peoples' lives), I used to work at a call center, and a big portion of our reviews were based on customer surveys.  The kicker to this was that if someone called into the wrong department, was treated poorly, and then transferred to you, they make take the survey thinking it was for the other person, but really it affected the second person they talked to.  Again, this is pretty different, but it is an example of how employers really don't care about what their employees have control over. 

I would hope they would care a little more in a drug testing lab than at a customer service center for a cell provider, but who knows?

I wouldn't be surprised if there was some sort of off the book incentive here.
Just looking at the Jolly Rancher article we know the Cops are happy to take clearly not drugs and claim they are.  So there's got to be a pool of cases where the cops are pretty certain no drugs were found but they want to put the people away anyway and leaning on the lab in one way or another is how you do it.

Just looking at the Jolly Rancher article we know the Cops are happy to take clearly not drugs and claim they are.  So there's got to be a pool of cases where the cops are pretty certain no drugs were found but they want to put the people away anyway and leaning on the lab in one way or another is how you do it.




To be honest, I hadn't considered the possibility of the police encouraging her in any way.  Although, if the police had been pressuring her, shouldn't that have come up by now?  I would think some weasel willing to do something like this would crumble during an interrogation.
