They wish they could prevent such a thing. There are reliable software applications that can get around their copy protection when they have it.

No, copying music for private use is not illegal in Canada.
Quote:
Important distinctions have been made about the legality of downloading versus uploading copyrighted material as well as "musical works" versus other copyrighted material. In general, the unauthorized copying or distribution of copyrighted material for profit is illegal under Canada's Copyright Act., however the act also states under the section "Copying for Private Use ... onto an audio recording medium for the private use of the person who makes the copy does not constitute an infringement of the copyright in the musical work, the performer’s performance or the sound recording.".[3] Furthermore, the Act contains a Private Copying exception that makes it legal to copy a sound recording onto an "audio recording medium" for the personal use of the person making the copy. This is supported by a levy on blank audio recording media, which is distributed to record labels and musicians.

thats cool, i found this
http://www.riaa.com/physicalpiracy.php?content_selector=piracy_online_the_law
which states
Quote:
Copying CDs
It’s okay to copy music onto an analog cassette, but not for commercial purposes.
It’s also okay to copy music onto special Audio CD-R’s, mini-discs, and digital tapes (because royalties have been paid on them) – but, again, not for commercial purposes.
Beyond that, there’s no legal "right" to copy the copyrighted music on a CD onto a CD-R. However, burning a copy of CD onto a CD-R, or transferring a copy onto your computer hard drive or your portable music player, won’t usually raise concerns so long as:
The copy is made from an authorized original CD that you legitimately own
The copy is just for your personal use. It’s not a personal use – in fact, it’s illegal – to give away the copy or lend it to others for copying.
The owners of copyrighted music have the right to use protection technology to allow or prevent copying.
Remember, it’s never okay to sell or make commercial use of a copy that you make
"The copy is made from an authorized original CD that you legitimately own?"
after reading that i was trying to look up laws regarding borrowing material, to find maybe a loop hole , that you own the material while its in your possession, but wasnt making any progress with that

so blank materials are taxed, with the expectation people will copy the music?
so is ripping to mp3 bypass that? should i be copying to a blank disc, then uploading to my mp3?

Kind of irrelevant because there's no way anyone is going to find out.

Okay, well dude. It depends where you live. Are you in canada, or america or elsewhere?
If youre american, what the RIAA posted applies to you.
If youre canadian, what psi applies to you.
and in canada we charge a level on blank cds, ipods, memory cards, pretty much anything that has the reasonable expectation that copyrighted media may be used.
But if you are in the states, it is completely different.

The laws were originally there so you couldn't make a profit off of the work or promote it as something it isn't, but with the music and movie industry shitting money out the asshole because they've become a shell of their former selves they go after people and use their money to their advantage every time a new technology comes out.
They're uber tight assed you can share work with people with no detriment to yourself.

Just like anything, it's only illegal if you get caught.
