Family Legal Matter - Help, Please

Gonzo has a brother named Spike, who is in his late 30's and still lives with his parents.

- Spike was diagnosed with a learning disability at age six, and was admitted to a psychiatric hospital for two weeks in the early 2000's.
- Spike does not work, and refuses to look for a job.
- Spike refuses to even try any type of vocation/rehab service.
- Spike lives for free in a basement apartment, and pays no room and board. Parents also pay for a car--including insurance. Parents provide food and clothing for Spike, and cash is given pretty much on request
- Spike is obese, has a horrifying diet and exercise routine, and is headed for serious health problems. Example: not uncommon for Spike to eat a stick of butter on his eggs for breakfast.
- Parents are in their late 60's

Gonzo asserts that Spike has been and continues to be babied. He should at least get a job delivering pizzas or something like that. If that's not possible, and Spike can't take care of himself, then he should apply for Social Service Income, and be put into a group home with supervision.

Parents refuse to do this, and kicked back fiercely at the suggestion.

Gonzo is getting a really bad feeling about all of this. Parents seem to expect Gonzo to step in and pick up the slack as they grow too old to keep this ship afloat. Needless to say, Gonzo this is a big responsibility, and Gonzo isn't thrilled about the expectation to fill these shoes. It's also becoming a concern to Gonzo's significant other.

Parents went to a very expensive estate lawyer to write up their will, but refuse to give Gonzo any details. Parents utterly stonewall, and will not discuss the matter any further.

QUESTIONS:
1. What type of law is this? If Gonzo wanted to talk to a lawyer, what type of lawyer should he look for?
2. What is Gonzo's legal responsibility in all this?
3. What is an appropriate course of action for Gonzo?
4. Um... wtf is going on here?

Thanks for your advice. Gonzo doesn't know what to do.

Please forgive if this maybe belongs in Sexuality and Relationships, but it's a legal question, and the smartest Shroomerites are in this forum.

Not your problem, just try to be a good family member and make life as pleasant and interesting as possible for your parents and spike.

Sorry to hear that he is on a bad path.    He is probably pretty set in his ways and its unlikely he will change no matter what you do.

Getting him on ssi is probably a good idea, and that is so
ething you should talk to a special ssi lawyer about.

Omg my current situation is the same, well except shes not fat and the will part, and sorry for going off topic lol i just feel relieved that Im not the only one who has a lazy sibling who blame there psychological problems for there laziness.

Well, it is my problem... maybe not today, but my parents aren't going to live forever. I don't want to put myself in a position where he comes knocking and it's either my couch or the street.

Perhaps that's the key thing for me to do at this point: put a plan together, and be ready to execute. Find a good group home for him, have an SSI lawyer lined up, etc..

If nothing else it will put my mind to rest.

You can't do anything to prepare for it.  If he shows up at your door expecting help, all you can do is help or not help.  You can't force him into any kind of home unless he's declared incompetent....From the facts, that doesn't sound likely.

There's the chance that being faced with survival for the first time will radically change him.  Many people fall into the trap he's in but get out pretty quickly when the gravy train stops.

There's also a chance that he'll just die because he can't survive.

Either way, the problem is solved.

My advice is to focus more on yourself.  Regret is a shitty thing, so you should start trying to figure out what you can and can't live with.
