Feds will continue to jail pot dealers ‘in all states’

The White House has pledged to continue to jail those who traffick in marijuana or sell it to minors — even in two US states where its recreational use is now legal.

At a hearing before the Senate Judiciary Committee, Deputy Attorney General James Cole defended the federal decision not to challenge new laws legalizing marijuana in Colorado and Washington states, approved by voters in November 2012.

Those law clash with federal laws which classify marijuana as a Schedule One controlled substance, on par with heroin.

The US administration has been criticized in some quarters for taking a hands-off position to prosecuting pot users in the two states since the passage of the laws legalizing cannabis.

Coles vowed however that the federal government would continue to go after those seeking to profit from selling marijuana, or those who would seek to traffick the drug to children.

“We’re not giving impunity” to drug traffickers, he insisted.

Cole pledged that in addition to blocking cannabis cultivation and distribution, US authorities would work to prevent the export of marijuana to places where the substance is still illegal, “whether the state has legalized it or not.”

And he added that Justice Department officials “reserve the right… to challenge the state laws at a later time.”

In the US, 21 states have authorized the use of cannabis for medical purposes. Of these, 16 states have decriminalized possession of the drug in small quantities for personal use.

Colorado and Washington went even further, legalizing recreational consumption of the drug. Colorado even allows limited at-home cultivation of the plants.

Drug policy expert Kevin Sabet — a former official in the administrations of presidents Bill Clinton and George W. Bush — said legalizing pot was dangerous, because it could lead to the “creation of a Starbucks of marijuana.”

“Why would we open the floodgates?” he asked.

But John Urquhart, a sheriff in Washington, denied that that US west coast state was going to become a drug haven.

“What we have in Washington is not the wild, wild West,” he said, adding he doesn’t see a “conflict” between the federal and state laws.

“We all agree we don’t want our children using marijuana. We all agree we don’t want impaired drivers. We all agree we don’t want to continue enriching criminals,” he said.

“Washington’s law honors these values by separating consumers from gangs,” he said.

It is legal, but I bet you there will be some federal interference in those states.  The feds don't tend to follow any laws...straight up.

Are you not aware that in the USA federal law trumps state law?

States are free to pass whatever laws they wish. So are the Feds. The Feds win.

Now, you can debate whether or not it should be that way. What is long settled in this country is that it is that way.

So, what I'm getting is as long as you aren't trying to traffic to other states, and aren't selling to kids they'll for the most part stay out of your way?

What seems to be the issue?  I think the headline of this article is highly misleading.

The article makes it sound like they're talking more about sell to minors, out of state trafficking, and black market sales, so I think both.

There's a strong psychological element to why people are acting that way.  I personally don't understand it, but for a very long time a great number of people have been very comfortably totally uptight about weed.  They don't smoke it, and the pothead kids that used to rent nearby always blasted that damn music.  Many of them don't even really understand why someone would ever want to smoke weed, and in many ways the medical aspect is like describing an abstract painting to a blind person.

So, suddenly people are voting and normal, everyday people who don't smoke pot are being forced to think about it in more than just a passing manner or how big the latest bust on the news was.  They feel like there is something inherently wrong with intoxicant use for recreation.  In the most hilarious cases, they might express this point of view over a few pitchers of beer or bottles of wine with friends.  So, these people feel like a concession is being made to a group of people with base interests (getting high), and that like with any compromise they need to get something.  So they go nuts over people selling to minors, because they are a very difficult group to really say much good about or defend.  They get to feel like they are making a countercharge against all of the potheads for legalization, and they don't have to put much skin in the game in terms of being able to defend their position (super easy) or be seen as wanting to send people doing nothing wrong to jail.

I don't think the feds have ever gone after Joe Shmoe for dime bags.  They leave that up to the states.  So nothing has changed in that regard as far as I can see.  I hope the point of this article is just that they're going to keep it away from kids.  That's cool with me.
