Rent deposit lost in the mail

My old landlord sent our rent deposit check to my old roommate's mother since all of us were in various states of homelessness after the lease ended. Roommate moved into her new place and her mom sent her the check...and it hasn't arrived after a week.
What the fuck do I do? I don't think the landlord will write a second check...can I make him, legally? The deposit was all mine because the other roommates owed me money and it was quite a bit of change, we kept the place up nice. I don't make a whole lot of money and am screwed if I don't get this check.

If u didn't cash the check I'm sure the landlord will void the old one..and write a new one.

He might take out the fee it costs to stop a check, but he can't simply say that he sent it and since you didn't get it you're SOL. It sounds like your old roommate has the check and is going to take the whole deposit though, things don't just randomly get lost in the mail.

True, but "roommate" doesn't qualify as a person to trust. Scams go down all the time with people looking for "roommates," usually in another state, and requiring a deposit check. Get there and realize that they don't even live there. This is the other way to do it. Take the deposit refund check and say, "Iono."
I still think it's more likely the roomie is ripping you off than it got lost. One way to check is to call the landlord and see if it's been CA$HED yet.... if not, they usually don't even charge a void fee..
I'd be more worried about your ability to prove the debt and your share of the check in small claims court once the check has been cashed. How recent did the mom send it? There IS holiday mail lag but i think you may be kissing it goodbye.

Its only been a week dude, can well take another two weeks. Not that it should.
If it doesn't come in I would call the landlord and ask if it was cashed, to see if your roommate did get it. Not sure if its worth assault or a lawsuit, but getting robbed is definitely worth cutting someone off IMO

yeah, landlords will usually deal straight with you. They have to go to court often enough as it is, and they HATE it... but they'll get put out of business if they don't go. So they do as much as they can to avoid it. And small claims court isn't that difficult with sufficient proof.

Yeah, I dunno, it sounds kind of shady. I would at least call the landlord and talk to him. It will be pretty easy to solve. Either it got lost in the mail and he can stop the check, or it didn't and it's been cashed. Maybe it didn't arrive yet or it really did get lost. Or maybe you're getting fucked over by your old roommate.
Regardless though you (OP) should be calling your landlord instead of asking us for advice. That's pretty much the only course of action.

If the check has been cashed, it should be easy to verify by contacting the landlord.

Your room-mate has the check. If Im reading it right the landlord didnt mail it out, he gave it to either someones mom or the room-mate who then said they mailed it out to you but, surprise, it got lost. You've been had.

I typed it in manually once upon a time and then bookmarked it so all my searches would be encrypted.
It was something I came across in an article about online security.
