yeah first DUI. VERY VERY sketchy circumstances surrounding my arrest, can't wait to read what bullshit the arresting officer fabricates in the police report
long story short I was eating a burrito in a restaurant and was arrested for DUI.

in my state they have to either be in the ignition, or you are sitting in the driver seat, or even if your engine is warm.

I have been convicted of multiple dui's in the past, gets worse every time. But i don't even drink anymore. Yeah i always loved reading about what i did from a cops perspective

Here if you refuse a breath test it is automatic license suspension. And in one county here i have been to, you have a mandatory drug test for pretty much any infraction at all. And yeah i flunked mine and got 6 months in jail for it.

but if we can prove the arrest was bullshit then the breathalyzer will be thrown out.

I cant give any more details until after the court hearing but the only question he asked me was "sir have you been driving safely this evening" to which I replied "yes".
that doesn't put me in a car over .08. and it doesn't put me in a car in the time frame they arrested me for. just that I had driven safely at some point that evening.
that puts me in a car. not maybe even the same car they received the tip on.
the whole thing is 
again... full details later.
and god knows the police report is going to be full of complete bullshit lies

dude I was driving 30 mph on a one way from the bar to the restaurant, about 8 blocks total.
I would never go on a highway after drinking more than 2 drinks period.
I am actually super SUPER against drunk driving.
this was either some kind of sting operation or they had an undercover tail me.
I have no idea.

This is exactly why I got mine dismissed. Its called corpus electi, they can't prove u were the one driving...or drunk at the time because they didn't pull me over..they showed up after I crashed

Cops watch bars all the time, its not hard for them to get easy DUIs that way. I don't think its legal, but they do it anyway and its hard to prove.

What crazy luck both you and me have i also had DUI court today on the 29th... The state gave me for my first DUI 6 months probation dui school 50 hours of service 1 class of some bullshit and a 350$ "donation" to some program ... Anyways I violated the stupid program by getting a DWLS and now the state wants to give me 180 in the MDCJ Im hoping to turn that 180 into 90 somehow but i wont know until next month... - - (The way i got caught was i left a party after downing shit ton of beer knew i couldn't drive so i decided to go to sleep in my comfy ass car and i live in FL so its hot. i decided to turn on the car put some tunes on and blast the ac... I wake up with about 9 cop cars and a ambulance.. they taught i was fucking dead but i was in a deeeep sleep they also wanted to bash open my window that's what actually woke me up " Last warning before i break your window ..break your window window window" and i woke up like WTF is going on. I had an open freak-in beer and they took me in i blew 1.05... Them fucking laws. Worst Newyear ever!)

I don't do it anymore because the laws in my province have stiffened SO bad to the point the cops can play judge and jury. Even if you blow a 0.01% they can give you a 24 hour, impound your vehicle and make you pay points off your license, if they "feel" you aren't safe to drive. This is being appealed as we speak. But because of the huge increase in people getting fucked over and having their licenses taken away, I don't drive drunk.
I did a solid 10 years of it though, multiple times a week. It's shmeh. The smear campaigns are the exact same ones that target all your precious drugs you all whine about so much. It's mostly propoganda.
If I feel fine to drive and I know I'm in good shape, I'm going to do it. Well that was my mentality back in the day when the laws were more lax anyhow. I have avoided accidents with dumbass old people that shouldn't be driving while under the influence of alcohol.

Even with a BAC of .15 people only have crashes an average of every 2,000 miles. It's very rare to get into an accident even while drunk. That doesn't mean it's a good idea. It does mean that you don't have a very good handle on exactly how risky your actions are. People aren't capable of really understanding such odds.

I've driven drunk. There were times when I thought 'hey, no big deal' and times where I could barely keep my eyes open and on the road. That line between 'I'm cool' and 'Eye'mah cuhoool bra' is blurry to say the least. Thing is, even when you've had just a couple beers, it's still no fun. I'm always worried about a checkpoint, or someone else doing something stupid and getting fucked over. So I skip the whole thing and just ride my bike to the bar. I can get as smashed as I want and still be able to ride in a straight (enough) line to make it home.

I've driven drunk over 1,000 times and I've yet to get into an accident. Just make sure to be the least drunk person of the road. Where I am from is different though, only certain towns try to nail drunks. Too many alcoholics near me to get all of them.

It only takes once.. My aunt didn't make a habit of doing it and ended up T-boning some family and killing (at least one of) them. No priors. She did 15 years in prison for manslaughter. The psychological damage she suffered (not to mention the physical damage) is for life though..
You get in a wreck and it doesn't matter who is at fault if you're drunk. You will be liable.

I am actually having real trouble finding where I got that statistic from. I suspect I may have derived it from other data. Here is some relevant stuff though:

I've been stopped by the sheriff on my bike, pretty recently too. I was shitfaced, though not falling down drunk, but he had to know. He stopped me because I blew through a stop sign, and was going so fast he thought I was running from him He checked my ID, I shot the shit with him a little and asked how fast I was going, he let me go on my way. Try doing all that drunk in a car. You'd have to be a real shitshow hitting cars or falling over to get a BUI.

The same thing can happen if you are stoned and I know enough people here do that as well. I try not to make a habit of it, but more so out of fear of a DUI than fear of an accident.

I think driving while high is stupid as well.. I know I'm in the minority about that here.
I've never supported the "everyone else does it so it must be okay" mindset... Doesn't matter if everyone is high while driving, I still say it's dangerous. Maybe I'm just a special kind of person and smoking weed doesn't slow everyone else down, although I highly doubt it, but anything that impairs my ability to think clearly and react fast cannot be good for something as inherently dangerous as driving.
I'm the same way about driving while very tired/sleepy and texting while driving.. I see them all as dangerous and unnecessary. If someone is finding any of it nessecary then that someone needs to plan ahead better.. More time to sober up/sleep or pull over to text if it's that important.
Don't even get me started on that "smoking makes me a better driver" shit either.. That's the same thing stumbling drunks say. It most certainly doesn't make them a better driver, they just don't notice all the mistakes they're making.

I won't disagree that there are better and worse drunk drivers.. My uncle has been convicted quite a few times for DUI and wrecking cars while drunk while my grandpa did it every day for almost my entire life and never got in a wreck or pulled over..
Although that doesn't mean it was safe for him to do.

My step dad is a functional alcoholic. Very cool guy. First thing he doe every morning is drink a coffee then head to his car with his cup filled with a beer. He is 60 years old and not once had a DUI. Although I dont recommend drinking and driving.

Now for ALL of the details!!!
I was at a bar, drove roughly 8-10 blocks to a Mexican food place.
The police received an "anonymous tip" that a car was parked crookedly and the passengers and driver were suspected to be intoxicated.
After being in the restaurant roughly 5 minutes, several officers came in and asked if they could talk to me outside for a bit.
I stupidly said yes. They then asked me if I believed I had been "driving safely that evening" to which I also replied yes.
They then placed me in handcuffs and arrested me for DUI.
I repeatedly asked for a field sobriety test and was denied.
NOW FOR THE FUCKED PART: the police report says that they offered me a field sobriety test and I DENIED it. COMPLETELY FALSE.
They also said that they asked me "did you drive HERE tonight", rather than "have you been driving safely tonight"
so basically an anonymous tip turned into suspicion and arrest, and then later they fucked up the police report to make it look like they had probable cause.
THE SILVER LINING: I was granted diversion.
Fucking asshole cops, the police report is complete horse shit. problem is they know it would take me about 6-8 grand to take them to court and I would risk losing the option of diversion.
seriously, I have much less respect for police now. they completely and utterly fucking LIED in the police report to cover their own asses.
oh, and conveniently their dash cams were MUTED during my encounter.

fucking. assholes.

haha that was before my court date and I was very careful how I phrased things on here, didn't want to incriminate myself. I don't remember saying I wasn't drinking at all.

In the first thread he made it sound more like he wasn't going to drive home drunk, and kinda didn't say whether or not he drove to the restaurant drunk(even though he obviously did) but more that they wouldn't have had proof that he drove to the restaurant while intoxicated.
That's just what I got out of it when I read the first thread.

Yeah man it doesn't matter how you answer their questions, if you say anything at all they'll twist around and completely lie just to incriminate you. At least now you know that literally anything you say will fuck you over though.

seriously, I've been in this drug game for several years and had a lot of close calls where my knowledge of the law got me out of it.
but this shit was completely fucked where they completely fabricated the police report just to cover their own asses.
EVEN IF YOU ARE CAREFUL WHAT YOU SAY THEY WILL JUST LIE.

you can be as smart as you want. you can be a fucking lawyer and say everything perfect but it wont even matter.
do not ever speak to a police officer for any reason at ALL EVER. anything they want to know can be asked after you are arrested, and in a court room by a judge.
