Maybe she has a phobia of drowning and wants built in flotation devices..

We don't know all of the facts, but murder sounds like a stretch. I doubt even the "plastic surgeon" is guilty of murder. It's quite possible that she's guilty of fraud and perhaps conspiracy, but the murder charges do seem out there.
Man though, sitting around in prison for eight months on trumped-up charges? It just seems so extreme.

This is fairly typical shit, though. Prosecutors routinely overcharge people to get them to plead to lesser charges. It's the same principle as doubling prices on Thursday in anticipation of your half-off-sale over the weekend.
I think after eight months it's too late for the half-off sale...
Thanks for the input, Enlil.

I wish it were less common, but I've had many clients sit in jail for over a year on bullshit charges. Poor George Zimmerman lost over a year of his life on politically motivated nonsense charges.

didnt she?
she advised someone to go see a 'doctor' that wasnt licensed to perform medical procedures, in plain english, he wasnt a doctor, this person killed the 'patient' whom never would have been there had she not been instructed to go by this plastic surgery nightmare, she sure as hell seems complicit in the woman's death

It does sound like she was complicit in the woman's death. The death sounds more like manslaughter than murder from the available information though.

every time I see one of these threads I look at it to find out why people want to defend an obvious murderer, in this case the murder wasnt committed with her own hands but she still holds some culpability in the death, still, why the hell do people desperately seek to free people so stupid that they pose a danger to the public

What's your rationale for saying that the woman's death was a murder at all?

Morris Garner, who also goes by the name Tracey Lynn Garner, was previously charged with depraved-heart murder in the death of 37-year-old Karima Gordon of Atlanta. Depraved-heart murder is a legal term for an action that demonstrates a "callous disregard for human life" and results in death. It carries a life sentence.

Quote:
Depraved-heart murder, also known as depraved-indifference murder, is an American legal term for an action that demonstrates a "callous disregard for human life" and results in death. In most states, depraved heart killings constitute second-degree murder.[1]
If no death results, such acts would generally be defined as reckless endangerment and possibly other crimes, such as assault. Common law background
The common law punishes unintentional homicide as murder if the defendant commits an act of gross recklessness. A classic example of depraved-heart murder under the common law is in the case Commonwealth v. Malone, where the court affirmed the second-degree murder conviction of a teenager for a death arising from a game of Russian roulette.[2]
http://en.wikipedia.org/wiki/Depraved-heart_murder
I suppose maybe murder charges do make sense in light of that. Even though the death seems to have been an accident, the procedure carried a big risk to the woman's life and everyone involved should have realized that.

The main issue is that she had a monetary incentive to give this advice, this was not an innocent mistake, this was about her making money regardless of the risks for the patient.

As far as I understand, she (along with Garner, the surgeon) is being charged with "depraved-heart murder", which means that she (allegedly) knowingly and recklessly put somebody's life at risk. I don't think this charge will hold up, as this appears to be the first time Garner has killed somebody with his/her surgery; Pebbelz obviously survived the surgery and had no reason to expect the victim's experience would be any different.
I'm wondering about the wire fraud and conspiracy charges. Is conspiracy to commit murder the same as murder? And what aspect of this case is "fraud"?

Depraved heart murder is a real stretch under these facts.
