Houston Deputy Sues Woman Who Dialed 9-1-1

August 16, 2013 Houston, Tx - According to a report by KTRK, Harris County Deputy Brady Pullen has filed a civil lawsuit against a woman who called 9-1-1 last December.
The defendant, Camina Figueroa, dialed 9-1-1 due to an emergency at her home in Katy, Texas. When Deputy Pullen responded to the call, he claims he was viciously attacked by a man who had been on “bath salts for days.”
“Pullen alleges Figueroa failed to ”adequately warn others that her resident or guest Kemal Yazar posed a violent threat to others,” reported the Houston Chronicle.
When Yazar allegedly confronted police and EMS workers, deputies “fired shots at him, killing him.”
Deptuy Pullen said he suffered from a “broken nose, concussion, lacerations and bruises.” Pullen is seeking $200,000 in damages from Figeuroa.
The Houston Chronicle reported that the lawsuit filed by Austin attorney Mark W. Long states, “Yazar had been either smoking or ingesting a drug commonly known as ‘bath salts’ or some other mind-altering substance for days.”
Pullen’s Austin attorney said, “If someone is injured due to a homeowner or renter’s failure to warn of dangerous circumstances, then you have a right to sue.”
KTRK’s legal analyst Joel Androphy argues the deputy should know the situation could potentially be dangerous when responding to a 9-1-1 call.
Harris County Sheriff Adrian Garcia calls his deputy’s lawsuit “unprecedented.”
“We’re allowing our legal staff to manage this case and we’ll see where it takes us,” said Garcia.
KTRK’s legal analyst said, “It sends a bad message out there. And if this lawsuit succeeds, it basically shuts down 9-1-1 calls to some degree, because people will be afraid if they make the call they are going to get sued. And the sheriff should not condone this type of action.”

So he killed a guy and he's suing over a broken nose? Isn't going into a 911 call inherently dangerous? First thing they teach you in any emergency training class and even freaking Boy Scouts is survey the situation for yourself and determine the dangers. I'm assuming the emergency was the guy on bath salts was acting crazy so Figeuroa called 911.

This is beyond dumb. This kind of thing is part of their job. If the deputy wins this case then whats to stop other cops from finding ways to get themselves hurt on the job and suing residents at the crime scene?

Ain't that the truth, a lot of the cops I knew in the suburbs were panzies. They had big muscles, wore bullet proof vests all day, killed some people's dogs, and would talk shit - but at the end of the day they would call 4 cars of backup to arrest a few pot smoking teenagers.

Isn't it part of their protocol to call backup in certain situations? Maybe dangerous ones or ones involving multiple people.

On the other hand those guys were so soft I would feel more threatened by the teenagers, so maybe backup was merited.

The cop murdered the man on bath salts. That was a person, with desires and wants and needs... a human. The deputies shot him dead.
The correct response would have been to detain him, and let him sober up and get on with his life. But no, they instead robbed him of it.

I know cops.1% are good people,the rest got picked on as a kid and see their job as a way to get revenge.

The actions of law enforcement get more and more sickening every day, and I can't even believe this lawsuit got off the ground. What's next, firefighters suing you if they get burned putting out your house?
I do feel bad the bath salt zombie lost his life, but breaking a cop's nose.. I'm really not surprised by the outcome.

The possibility of dangerous encounters with people while being a police officer is part of the job. Not only is it part of the job, police are financially compensated for the possible risks of injury they could face. I will agree that police should be able to sue provided that the up front pay they receive for the potential risk of injury be revoked. You became a cop, you know the risks, you accept the risks as part of the job.
