So on Sunday I wasn't scheduled to work but I received a call shortly before 5pm asking if I could come in ASAP to cover for someone who was a no call no show for his 430 shift. Well, I had a pretty 9% 24oz IPA around noon with my lunch, and then I had started drinking at about 330pm. I had had exactly 4 1/2 shots of vodka in two screwdrivers in a little under 90 mins. I am Irish and I live up to my heritage, so I wouldn't say I was drunk however I can't deny that I certainly had a very healthy buzz going that was approaching drunk, but I was embarrassed to tell them that I was already entertaining a buzz by the time 5pm rolled around on a Sunday, so I told I had put my car in the shop for repairs since it was my day off. They said "we can arrange for someone to pick you up; please come in we really need you we had one call in and oneno call no show". So I said okay fine, brushed my teeth, ate, and had someone come pick me up for no reason cuz my car is fine lol. Though I suppose it was good so I didnt have to drive semi drunk. I was nervous it would be him who got me and he'd notice but it was my corworker- who did notice but doesnt care, he talks about boozing all the time.

About an hour into my shift my Asst Manager approaches and pulls me aside. When we get outisde he just asks me whether or not I've been drinking. I say yes but lied and gave the standard "two beers" excuse and explain what happened with getting called in on my day off. He said a customer commented that they smelled alcohol on my breath and he said he could smell it too and he said he also noticed some slur to my speech- that it seemed like I'd had more than 2 beers. So he gave me a breathalyzer and my BAC was .15. He sent me home and suspended me for the week and said they'd be in touch.

So I was told today that I'm being terminated. I'm sad, I really liked this job and felt that I was an asset the company; in fact I'm surprised they didn't try to find a way to overlook it, however it is a very professional company. Do you think I did anything wrong or did I get kind of screwed over? I told him I felt it was unfair and he said if I'd been honest they would've told me not to come to work and this wouldn't have happened. But I felt like they were really pulling my leg to come in.

why didnt you just tell them you couldn't because it was your day off and you we're already buzzed?

I dunno man it was a bit of an impulsive lie. I didn't consider that they might would offer to give me a ride, seems odd to me for such a professional company. I thought even if I said I'd had a beer or two they'd ask me to come in because of how desperate they sounded, but not if I were completely honest about my choice of Sunday activity

a. Not had to go to work on your day off
b. Not been fired!

Sorry bud but you are in the wrong. Next time you are requested to come in and you're drunk, tell them no. It's as simple as that. Life goes on and you'll land another job.

I figured it was an act of good faith; refusing to take it just seems inherently dishonest. They're not cops, it isn't a legal situation, they are just asking you as an employee to do them a favor. They could have fired me on the spot just for suspicion and/or the mere smell and confession of having consumed two. there is definitely a no tolerance policy I signed. But throughout the conversation and up until I got the call I believe I would be able to keep my job because I perform very well at it and I feel I was an asset a new and weak company with a lot of potential to do well in the right hands.

I understand where you're coming from man.

My advice is never feel loyal to a company and never feel obliged to go out of your way to help an employer if it's going to cause havoc in your life.

Something I've learnt in my working career.

Not sure how it works in the US, but in most cases you can are only legally obliged to partake in random D&A testing if you are employed in a 'safety critical' position. As stated above, this is fairly explicit in your contract of employment. However, most employers can choose to add this if they wish for almost any position out there.

You are in the wrong on this one because every company [I assume yours included or you could file for unlawful dismissal] has a Drug and Alcohol policy. Usually summed up in that you can't do either prior or during a shift.

I know it's not what you want to hear, but you would of been so much better off telling them you'd been drinking on your day off as you could have really brought the house down on them for discriminating against you for that.

I'd say that their in the wrong for calling you on your day off, your cool enough to go in then they get all high and morally mighty on you.  Find out who turned you in for drinking and kick the shit out of them. 

I mean, what's the fun of being Irish if you can't do anything stupid.

Sorry for your shit luck.  I've done the same thing before but it didn't end so badly for me.  I guess it depends on the sort of job you are working, because I was in food service at the time, and we were preparing for a function and it gave me a chance to drink copious amounts of coffee before I ever had to interact with any customers. 

It's a hard life lesson, but next time you should at least be up front with your employer.  I know it seems difficult to admit to someone in that position that you've been drinking, but it was your day off, and you probably weren't considering yourself to be "on call" for them.  That being said, if you have a job that you care deeply about, and wish to rise within the ranks, you might want to weigh your responsibilities against your vices.  5pm drinking is perfectly reasonable, if you ask me.

Do you work at a restaurant? Last time I had a job where I could potentially be "called in" to cover for some fuck wit co workers, I tried to play it off like you as well. I would always oblige because I thought I'd be doing my reputation with the boss/company a favor.

I didn't get fired but basically got taken advantage of because I was hoping to keep good report. I would come in and cover for people being "sick" and they'd be out having fun and getting drunk or whatever. It might suck to hear, but if you got fired that easily they might not have valued you that much in the first place.

Fuck that place and move on. You're a smart person from what I've read, and you'll find a company who values your work ethic to the point of not calling you on your days off unless something is on fire or tons of money was lost/has the potential of being lost.
