My Fellow Users,
I have been forced to make a difficult decision: to become complicit in crimes against the American people or walk away from nearly ten years of hard work by shutting down Lavabit. After significant soul searching, I have decided to suspend operations. I wish that I could legally share with you the events that led to my decision. I cannot. I feel you deserve to know what’s going on--the first amendment is supposed to guarantee me the freedom to speak out in situations like this. Unfortunately, Congress has passed laws that say otherwise. As things currently stand, I cannot share my experiences over the last six weeks, even though I have twice made the appropriate requests.
What’s going to happen now? We’ve already started preparing the paperwork needed to continue to fight for the Constitution in the Fourth Circuit Court of Appeals. A favorable decision would allow me resurrect Lavabit as an American company.
This experience has taught me one very important lesson: without congressional action or a strong judicial precedent, I would _strongly_ recommend against anyone trusting their private data to a company with physical ties to the United States.

Sorry to hear matey, the climate in the digital world is completely and utterly fucked from the perspective of our government. Maybe it will change, but not while Obama is in office.
Just last week a homeowners door was bashed in by the SWAT team because he googled "bomb" and "backpack" in the same day. No one is safe, and i've also recently taken precautions to secure my business and myself online from our prying governments eyes.

Yeah I agree, they blew that pressure cooker story WAY out of proportion. Newspapers were exploding about it for a while even though it was no big deal. I detonate how people can be so interested in such a story. I'm sure they thought they were killing it, but it really just exploded in their face.

Hey, thanks for correcting what i typed, I was going off the story i saw on the news, not off something i read here. Eluding to the fact I skewed the facts on purpose is ridiculous of you though, but thanks for the correction anyway.
Alas, my point still stands that there is a blatant disregard for the privacy of Americans. That story should have never come to fruition in the first place, "bashing" in door or not. I wonder what they cops would have done if the guy didn't just let them in, wtf is a "courtesy check"? sounds like a search warrant without the warrant to me.

Thank you for running your email service Lavabit (which, I did not know of, but had been searching for one like yours,) we certainly understand and can read between the lines of messages which you have not sent to us.

PS Excellent blog by Michele Catalano! Thank you for recommending it. Really does "ground" the events that happened that day. Turned out that the husband was also searching items from work , where TOS usually is that emails transmitted have the right to be intercepted. I've shared that with my peeps... tyvm

stick to the facts
there are plenty of blatantly illegal things happening in the police forces around the country, and in the higher echelons of government
courtesy checks are not one of them.
if the couple refused, they would have gotten a search warrant, and then bashed in their door.
