Psychoactive Substances Bill passes Third Reading

Associate Health Minister Todd McClay is delighted Parliament has passed the Psychoactive Substances Bill. The bill received overwhelming cross-party support with 119 members voting in favour with one against.

This new law provides effective restrictions on the availability and accessibility of so-called ‘legal highs’ in communities around New Zealand including:

· No sales from dairies or any sort of grocery store, petrol stations, or anywhere alcohol is sold;

· No sales to under 18 year olds;

· No advertising, except at the point of sale

· Anyone breaching the rules will face up to 2 years in prison or a fine of up to half a million dollars.

“This Bill is squarely about public safety and will ensure that the onus will be on anyone wanting to produce a psychoactive product to show it poses no more than a low risk of harm. It is fitting that I should at this time acknowledge the considerable amount of work by the Hon Peter Dunne in getting this Bill to this stage. He has been the driving force behind this world-leading legislation,” Mr McClay says.

“I am thrilled that Local Authorities, the police and health services now have an effective legislative tool that allows them to control so-called ‘legal highs’ in New Zealand. This is an important first step, particularly with the start of school holidays. But we need to be aware that for some, particularly young people, there may be withdrawal issues or other health-related problems that will need to be addressed.”

“Managing this will take a collective effort from those in the education, health and enforcement sectors to ensure that the appropriate steps are taken when these issues arise,” says Mr McClay.

The Ministry of Health is working proactively with DHB public health units and mental health services, Police and the Ministry of Education to ensure information is available to those who want advice and help services.

Public health units and Police will continue to work with dairies and other retailers who will no longer be permitted to sell so called ‘legal highs’ from the day of enactment. Police have agreed to collect unsold stock to dispose of in an appropriate manner. Any illegal sales following enactment will be prosecuted to the full extent of the law.

“The suppliers and distributers of these products have told us they want to be responsible. They’ve told us they want to make low-risk products, and market them responsibly. This is their chance to prove it. I call on them to start now with their collection of unsold stock and refund the cost to the retailer of these products, rather than waiting until this law is enacted”.

“Our Police and Health services have better things to do than go round cleaning up after this industry, so this is their chance to show social and community responsibility,” says Mr McClay.

The Ministry of Health has developed a website to address queries regarding psychoactive substances, which will go live at from 10.00am Friday 12 July.

Jesus fucking christ, just legalize the classics. I'd like to know where these politicians got they're pharmocology degree to be able to say this drug is safer than that drug.

its easier and faster to mix chemicals than it is to grow the plants that are illegal. its al about the $$$$$$$$

They will be able to sell the classics soon enough as well. Hopefully the US is going to make something like this.

I don't know what you all are cheering NZ about. this isn't a bill to legalize and distribute. it's a bill to require any substance sold for consumption to go thru the same stringent testing as any medicine or drug.

the portion discussed in the article is IF one were to get approval, how it would be sold, and, more importantly, the penalties for sales of products disobeying this law

Fair enough, but it is still a step in the right direction. NZ, for whatever reasons, seems to be a little more open-minded and progressive about this kind of thing. A number of years ago I legally took piperazine-based "party pills" when I was visiting NZ. Not quite MDMA, but effective, and novel to take something like that "legally."

Hopefully they're reasonable about their approval process.


It still seems like progress. It's better than what the US and other back-asswards copycat states have been doing, which is more or less saying "Oh, this is new, but has effects similar to something already banned? Off with their heads! Jail for everyone! More money for the Prisons Industry!  Viva Pharma Grande!"

Sorry for the rant. Just getting very tired of the blatant corruption and lies in the name of "public safety" even though they're "saving" the poor "addicts" by throwing them in prisons and marring  their record. Because they're either stupid as fuck, or corrupt. And I'm sure stupidity is a factor somewhere along the line. It would be preferable, really, as stupidity is easily cured by credible information. Which is why i think that can't be the case, because the results have been in for some time  now-- the "War On Drugs" is really a "War on Freedom" or more appropriately, a "War on People."  A harmful war on people. You can't honestly look at all the data and claim it's for the public good. It's clearly doing the public harm.  So we're either dealing with a particularly deep and widespread mental retardation, or blatant corruption.

I wonder how much longer the "War On Drugs" would last if "our side" started to treat it like a real "war" like "their side" does. And they do. There are some casualties, and many many POWs. What if "hard on drugs" politicians, and DAs, and DEAs started being assassinated? Imprisoned? Having their doors kicked in by men with guns, while they were with their families?


There aren't enough negative adjectives in the language for me to adequately describe this situation. It's dumb. It's sad. It's disgusting. It's fucking bullshit.


And that's why it's refreshing to see something like this-- something that looks like progress, however small.

This is a step in the right direction. They can't legalize classics because of the U.N. but they can legalize these to try to show it can be done responsibly and maybe the U.N. will change it's ridiculous stranglehold on the worlds drug laws

Some of the locals tend to be kind of open minded about drugs, but we still have a pretty high arrest record for pot related offenses. We can't even get a debate about medical marijuana in parliament. The main reason is because of Peter Dunne (mentioned as a hero in the article) refusing to even consider the idea. This will likely just be focused on the legal highs they are currently making and not already illegal drugs being tested for safety and eventually legalised.
