1.) no they can't trespass without probable cause on to farmers land.
2.)  never been caught in Oregon or at all:shrug:

A) They can arrest and charge you if you pick actives.  If you are picking edibles or poisonous mushrooms, that is legal on private property.

B) That depends on what kind of mushrooms.  If they are edible or deadly, you´ll be in the clear.  If they are psilocybin mushrooms, you would be charged with posession with intent to distribute 2 pounds of psilocybin mushrooms.  You might get a lot of probation, or prison time, depending on your lawyer and your previous record.

There will be a lot of police and rangers looking for you while you are looking for mushrooms.  Keep all mushrooms in a backpack and have a good cover story.

Liberty cap gill color does not vary by region, it varies by the stage of development that the mushroom is in.  If it is just a pin, the gills will be cream colored.  If it is very mature, they will be dark purple brown.

Are cops able to distinguish the difference between active and non active mushrooms? I mean, hell, there are a lot of people who know what to look for and can't even tell the difference.

The short answer is "no" for most police officers, but if you act shady and/or are dressed like a punk, and they search you and find weed or other drugs, and 30 of the same type of mushroom in a Walmart bag, then they will likely profile the sh*t out of you.

Police in areas where mushrooms grow know enough to sort out active and inactive mushrooms
Depends in you too... Do you look like some hippy?

To add to the above

active mushroom posession is a class C felony in Oregon last time I checked. Up to 10 years.
prison and fines

Most the time they don't wanna bother so will charge you with tresspass or some other thing.

Age changes gill color but you are 2-3 months too early for liberty caps... Sept-nov

Azures  grow in the fall around northern Oregon coast

I look clean cut, no issues here.

We've been stopped before by a realtor that was selling home in one of the neighborhoods that we were looking in. I had my work stuff with me (contractor), so I pretty much just talked to them and said we were looking for new land to build on! It sparked up a 20 minute conversation... So on an so forth.

I don't know how cops would react to that, but as the lady was walking up, I was pretending to take photos of the land and asked a lot of questions about who owned it and what not.

I mainly hunt for edibles, so it's not much of a problem either way.

In state parks in Oregon it is legal to pick mushrooms unless otherwise stated,they don't apply to the laws prohibiting you from removing wildlife from parks. So if you are picking mushrooms in the park I assume you are talking about and you don't give anyone a reason to think you are picking psychedelic mushrooms or breaking other laws then you will probably be fine. It is illegal to remove mushrooms of any kind from some (all?) state parks in Washington state, however.

Pro tip: While in the field pick edible and/or random mushrooms to ID later and if you get talked to, potential actives are far less likely to be noticed. Make sure to separate collections by species.

Wash state... State park rules are up to the ranger in charge of that park. Most allow eatables to be taken but always check the rules where ever you go for state or national parks.
Even freakn national forests now have rules... Thanks to the commercial pickers IMHO

Anyway... Always good to have a cover story..one time I didn't... I got caught by a Oregon trooper when younger (22) picking in a state park.... Hand cuffed and put into the patrol car... Took the mushrooms too... Some nice liberty caps...  Ended up with a stern lecture and being let go... Not a good memory

Most cops only know Psilocybe cubensis, however most Oregon cops also know liberty caps and the Psilocybe cyanescecns group.

The cops in astoria look for pickers during the season. Best advice would be to look somewhere in the same environment but just outside of astoria.

Also dont carry bags in the open or have wet pant legs. This is what I heard they look for.

@Alan, isn't there some new law that requires you to have a permit if you're going to collect more than a gallon of edibles?  I'm moving to Oregon at the end of the month and had seen somebody mention this at one time, was wondering how it works.

No you won´t get robbed.  The USA is a very safe country.

Don´t bring a firearm.  You won´t need it and if you have it, it will gaurentee that you will go to prison if you get caught with your mushrooms.

There are bears but they won´t bother you.
