DEFENDANTS ENTER GUILTY PLEAS IN HALLUCINOGENIC MUSHROOM CASE
United States Attorney John McKay announced that on August 13, 2003, ROBERT W. McPHERSON, date of birth, August 18, 1946, and his wife MARGARET M. McPHERSON, date of birth December 24, 1954, both of Amanda Park, Grays Harbor County, Washington, entered guilty pleas in Tacoma to charges related to their February 20, 2003, indictment for growing hallucinogenic mushrooms and selling mushroom spores over the internet. Both defendants entered their guilty pleas before United States Magistrate Judge Karen Strombom.
According to court records, the investigation of ROBERT McPHERSON was started in 1999 when law enforcement agencies around the country received calls from concerned parents whose children had received packages from a company called Psylocybe Fanaticus, operated by ROBERT McPHERSON. Those packages contained syringes with mushroom spores, and instructions on how to grow hallucinogenic mushrooms. McPHERSON operated a website to promote the sale of the hallucinogenic mushroom spores. The website also provided a first-person description of the mental disorientation and physical sickness that results from eating hallucinogenic mushrooms. On February 18, 2003, federal agents searched the residence of ROBERT and MARGARET McPHERSON in Amanda Park, and seized mushrooms containing psilocin, a controlled substance.
ROBERT McPHERSON pleaded guilty to the felony offense of manufacturing (growing) mushrooms containing psilocin. MARGARET McPHERSON pleaded guilty to possession of psilocin, a Class A Misdemeanor.
According to court documents filed as part of the guilty pleas, ROBERT McPHERSON acknowledged that he knew that the mushrooms in his house were hallucinogenic mushrooms, containing an illegal controlled substance. He also admitted that he sold mushroom spores that were intended to grow into hallucinogenic mushrooms.
MARGARET McPHERSON admitted in court documents that she assisted her husband in raising the mushrooms, and that she knew the mushrooms contained an illegal controlled substance.
Court records reflect that as part of their guilty pleas, ROBERT and MARGARET McPHERSON agreed to forfeit property used to commit or to facilitate the commission of the charged offenses, and property derived from proceeds they obtained as the result of the offenses, including the following:
A residence and real property on North Shore Road, Amanda Park, Washington. A residence and real property in Moclips, Washington. Real property on Lakeview Drive, Amanda Park, Washington. $78,286 in cash. Sentencing is scheduled for October 31, 2003, at 9:30 a.m. before United States District Judge Robert J. Bryan. ROBERT McPHERSON'S offense carries a penalty of up to 20 years in prison, a fine not to exceed $1,000,000, a term of supervised release of five years, and a Special Assessment of $100.
MARGARET McPHERSON'S offense carries a penalty of imprisonment for not more than one year, a fine not to exceed $200,000, a period of supervised release of one year, a period of probation of up to five years, and a Special Assessment of $25.
The investigation was a joint effort of the Drug Enforcement Administration, the National Park Service, and the United States Postal Inspection Service.

I wondering why he is facing 20 years for manufacturing.There's a book called mushrooms and the law.And only a hand full of states have up to 20 year sentence.Maybe because of the federal guidelines?If i was him as long as he did it and as much money he made i would of moved to the netherlands along time ago.(headquarters) How smart can you get selling these spores and growing in the same house.I wonder how much in wet wieght or dry weight they got.That would be like selling shrooms off your porch and growing in the same house not too smart.This just shows how of a fine line that the few other vendors walk on.I think it's great what the ones that are left are doing.And it has made a difference in the manner in which one can buy these spores.So in the long run all the other vendors are learning from pf.Stay safe you all................

Awww man, that totally sucks...
He wasn't exactly the smartest person though, any idiot would have done things different than him
Just get someone in canada to do the growing and printing for him and he wouldn't have ever had to worry about breaking any laws... hell you could even hire some kid to grow the mushrooms for him for a couple hundred bucks and just mail him the prints....
I don't understand why he would be so god damn wreckless with something like this... Spending 20 years in jail is pretty harsh considering he could have avoided it so easily...

Thats horrible but you have to say, he shouldn't of gave instructions, if he had used his real name, he should have went with a nickname and P.O. box. He should have his website to supply "gourmet and mycology research spores", and have them sold for intentions of microscopic research only. He literally put a sign up sayin "I only sell psilocybe mushrooms, I created the ever so popular pf tek, ran a website to sell the spores complete with visual and text information on how to grow, and then he set the manual which was just bound to be found by the wrong people". It is horrible they lost everything because of us.But you have to say he could of done 3 or 4 things differantly...................

Im also wondering why he didnt just move to the netherlands like somone in this post suggested. He could have moved the whole operation out of the states years ago!! But he must have had his reasons.

Yeah, I read in my local paper today that someone got sentanced to 4 years for rape, meanwhile PF is getting up to 20 years, a HUGE fine, lose of properiety and more. The scales of justice certianly aren't balanced.
I do agree though that he messed up. I really hope this doesn't effect other vendors anymore than it has.

I'm surprised nobody even wondered what the deal he took was. We may never know, but it sure sounds more like a plea bargain than a "plead guilty and hope they sentence you light".
Also note, that they plead guilty to manufacture and possesion of psilocybin. This has nothing to do with the spore business. This was people caught manufacturing and possessing drugs. All the paranoia going through the vendors should be put to rest as long as you don't grow and possess.
Regardless, I hope there was a good deal worked out for them, and that they didn't have to compromise themselves too much to get it.

Its all heresay to be discussing "what he should have done" - time can bring about a level of complaincy that makes people sloppy and obviously more vulnerable. I sincerly doubt PF started his business growing his produce in his own house - if he did well then that wasn't extremely intelligent.
As for selling instructions, well in hindsight it is a bad idea but if he had not got caught many of us would be none the wiser. Personally I dont think his strong ascertions that he was the inventor of the M mushroom growing tek and community helped him. I mean he never did anything but say he was the big cheese (and many people disliked that tinge of arrogance) - no judgement here but it opens you up to be a big target when you are the self confessed big man.

Well UG, it's not really hearsay. Back in like 99 or 2000, PF publicly joked about being staked out by the FBI, and saying that he's been growing and selling spores forever, if they haven't busted him yet, it's because they couldn't do anything. I think you hit the nail on the head with the arrogance thing. I guess his arrogance in other areas overpowered his common sense and desire for security.
Regardless none of that really matters. He's a man facing far more serious trouble than he deserves, even if he wasn't the smartest criminal, he doesn't deserve any time, much less as much as they could give him.
My thoughts may not have always been with him when he was in business, but they are now that he is a prisoner.

Sounds like the deal was this:
ROBERT McPHERSON pleaded guilty to the felony offense of manufacturing (growing) mushrooms containing psilocin. MARGARET McPHERSON pleaded guilty to possession of psilocin, a Class A Misdemeanor.
He took the hit so that his old lady would only be charged with a misdemeanor count of possession.

i have to say i am ashamed to live in this country lately, and this being a prime example why. being that I will never know my father because some drunk bastard hit him head on after leaving a bar and the guy served 4 fucking years for it...out of a 15 yr sentence. All this guy did was help spread mush. knowledge and hes facing 20 years. And as someone said earlier the average rapist and such get much less...THIS FUCKING GOVERNMENT NEEDS TO WAKE UP AND SEE HOW FUCKED THEIR LAWS ARE!

Hopefully mr. pf will get probation but it doesn't sound good. it's sad that the feds divert so much time, energy and money into a guy selling spores when there is so much other shit going on in the U.S. - murder, rape, terrorist attacks - i'm sure those feds could have been used elsewhere for more important things.

Somthing HAS to be done about the drug laws in this country!
My best wishes to the Professor, he is a true pioneer.
I'm wondering if anything could be done to help him. Maybe a letter to the judge? Or would that just implicate others into the mess...?
I hope he's shown some compassion. Hes an older guy and doesnt need to be in prision.
I'd like to see the 'Psilocin Production' operation that got him busted anyway.

federal court has a 90% conviction rate so once they have you they got you. most defendants do not plead "not guilty" the jury does not play when handing out time. i am sure pf has made a "plea agreement" and he probably will not get as much time as people think. even though his charge carries up to 20 years the feds go by a guideline that is affected by your past criminal record. also if his charge is fitted into the "white collar crime" which it should be because of the net the guidlines will go down. i know a guy who made checks on his computer stole close to a million bucks and only got 4 years. just pray.....

I was shocked to see all my 10 jars fruit... it went flawsely.
my latter pf attemts didnt go as well... haha
Actually I feel that the DEA thinks that the PF tek was the basis for The Shroomery it's self. They cant stop the site, but they did get the guy that started the most popular tek used on this site.

Sentencing date is set for October 31, 2003!? Holloween! Isn?t that funny. That is the type of wicked, evil, twisted, sense of hummer the judicial system has. I doubt that Robert has anything in writing from the prosecutors office as to sentencing recommendations prior to being coerced into accepting a plea bargain to keep his wife out of prison time, Mistake #1001.
They did that to a childhood friend, DOB ?53. This hooker wanted him to leave his wife and be with her, he said no. She sent him two ounces of Meth in a jar of instant coffee and notified the U.S. Postal Inspectors. To keep his wife and step kids from going to prison and foster homes, Oh Well, you know the rest of the story. The guy did sloppy work. He did not finish his homework on the project he started. The cakes dry out too fast and are prone to infection, not to mention, he mutated his entire stock in 2000 including his masters. It has cost me more time and money to finish his research than I can dream. Should I live long enough, I will write up the tek.
No one uses the U.S. Postal Service unless they want to do Federal Time. No doubt the DEA has a complete mailing list of all packages sent via the Post Office by PF which means the DEA has me on their mailing list, several times, Fuck. I already have Directv threatening to sue me because they got my name from a vendor they raided. Oh well, they wouldn?t find so much as a print on me if they did look. Obviously, Robert has never been in Prison, if he had, he would not want to go back!!

The one thing noone has noticed is that he did not receive a charge for "trafficking", just manufacture. He may have taken the plea to both save the wife and save himself from an even larger sentence. If they caught him with a large grow they could have added a trafficking charge(s) as well. Even though he may have been just growing the fruits to produce prints/syringes for sale, the government would be able to add a trafficking charge due to the large nature of his grows. They wouldn't give a shit what you tell them you were using the stuff for. Anyway, it is all conjecture right now.

Reguardless of inflated ego & unwise decisions & haveing the money to move his gig outside of the us, Robert is going to, in my estimation, do 5 years in federal prison. The feds expected this to trickel down, other venders to dry up scared & make an example, to put a huge dent in the mycology community, ( which in reality is tiny compared to international coke rings), basically due to the online upfront attitude with shrooms, they made a move, personally i would like to see records of these " alarmed parents", sounds alot like the " weapons of mass destuuction" that never were found in iraq. Fact is the us government can do what ever it likes & if they want "you", they will take you, or your entire country. I think it is time to look at Robert as the "father of the jar", and know that he did his part & stuck his neck out, realize that he went to prison for his actions & at christmas time send him cookies or batteries, books, magizines, music, or even a little cash to make him comfortable. I am sure that getting his prison address will not be a big deal & someone will post it. I think that the community should stick by him & not forget him, and be there in any way possible.

SENTENCING REPORT On October 31, my Wife and I went to our sentencing hearing at the Tacoma Federal courthouse. I was sentenced to 6 months home detention and 3 years probation. My wife was sentenced to 3 years probation. My sentence was based on the federal sentencing guidelines concerning drug felonies. I was calculated at a level 10 felony - zone B which provides as the minimum sentence - 6 months home detention. My wife got the minimum for psilocin (magic shroom) possession. She doesn't have to be drug tested. I have to stay clean and do periodic drug tests for the next 3 years. But, it ain't bad. I don't mind being unstoned (now that I am used to it).
The details of my sentence was based on the plea agreement my wife and I plus our lawyers signed on August 13 in Tacoma Federal court with the US attorneys office. To get count one dropped (the conspiracy to distribute), we forfeited some property and a considerable bank account (PF). We paid a fine of $125 for the court cost, but no fine for the sentence, which was a good thing. The forfeitures satisfied that. Plus, we keep our wonderful Olympic park rain forest house (my "prison" for the next 6 months). And a really good thing was that they dismissed my two other co-defendants (my wife's sister, Judy and their childhood "brother" (Steve).
The reason I got the minimum and a dismissal of two co-defendants was because the US attorney said that I cooperated with them from the day of the raid by taking the heat, telling them that I was the "man", and I was truthful and didn't hide anything. Also, I had a very small gro op in my house and they found 11.4 grams of dried shrooms in a waste basket. The DEA was surprised at the small ("miniscule" was a word they used in hearings) gro-op. But a gro-op is a gro-op, and any shroom gro-op no matter how small, is an automatic level 12 drug felony. I got a level 10 by pleading guilty with 2 points off for acceptance of responsibility.
So now it is over. It has been a rough 8 months, but my lawyer took us through it with expert advice through his many years of experience in the Federal court system. Without him, I am sure we would have been in major trouble and I would have been sent to prison (level 12 is an automatic 10 to 18 months incarceration).
Previous to the morning of February 18, this was the headquarters of PF. After October 31, it is the McPherson incarceration center for the next 6 months. The Feds gave me this house back plus my Seattle and Neilton cribs (home of ex defendant Judy). But under house incarceration, the inmate has 50 hours a week leave time for gigs. There is a sunday night rock and roll gig at the Pourhouse lounge in Aberdeen that the prisoner will be doing, Plus, solo piano gigs at the Lake Quinault Lodge

WOW!!! Thats great news!!!! I mean, it could have been MUCH worse. As long as the prof. doesn't have to do any jail time, thats great. Being an inmate in your own house is common in the USA, its called unemployment

Good news in either case - I was expecting much worse. Progression towards public understanding and tolerance of psychoactive substances is on its way and this sentence boosts my confidence just a bit more

I have followed this quietly but I must type, THANK GOD! I really believed that this man was going away for years...It sounds as if he had a superb lawyer and made very wise decisions after the "bust" began.
He actually comes across as a standup guy. I send out posistive thoughts and well wishes

Yeah, I agree, but it's still very good news. Considering how bad it could have been, this is a slap on the wrist. I wonder if they were more concerned with stopping the public outcry over his operation than punishing him.

This probably has been beaten into the ground, but, he also was on the Mycotopia board openly discussing how to make a crude psilocybin exstraction from shroom's.. He was very,very lucky that they did not bust him for DRUG MANUFACTURING.. The lesson is....be very,very carefull and check your ego at the door when dealing in this hobby. Lastly, none of this, this board and this hobby would not be what it is today, if it would exist at all, if it wasn't for Professa' PF I salute your mad, brilliant, arrogant genius...

Its a shame that such a mindopening experience, and such a great man are thought to be the downfall of our society. Rapists getting 4 years, murderers out after 10 and this man will be in jail for up to 20 years for providing a few natural things to the wrong people. Its a shame
