My friend got caught with posession of hash. He has court at 8:30 Am EST today, 5/6, and I want to help him out. Anyone know the laws and penalties for possession of hash? Is it the same as marijuana? That's the big thing - is hash considered the same as marijuana in Massachusetts - meaning a misdemeanor and a $100 fine?? or is it worse?
Here's the story. We are sitting on a hill at our college and he had an empty beer by his leg. An undercover walked up to us and asked his age, then searched his backpack because he had an open container of alcohol. My friend had more beers in his backpack and an empty sandwich bag with hash residue on the sides. He got arrested and charged with possession of alcohol and possession of a Schedule C substance.
He has court in the morning. The alcohol possession he is bound to be found guilty of but the hash residue..... is it even a Schedule C drug? Someone told me it was Schedule D. I was reading online and I found this http://www.bluelight.ru/vb/archive/index.php/t-411791.html. The link to the Wall Street article on the blog isn't working. Can anyone tell me and give me a link to has laws in Massachusetts? He has court in 7 1/2 hours I would really appreciate any help. He's worried about probation, a fine, and losing his financial aid to the college (it's a state college, and he has to answer if he's been convicted of drug charges on FAFSA, the student aid form).

Gotta know your laws man... http://www.malegislature.gov/Search/SearchResults?Input.Keyword=hashish
Sounds like you guys already screwed the pooch, so there's no point in sweating it.
Next time some stranger asks how old you are just point and holler "pedophile". Trash on the street isn't probable cause to search you. No reason you guys should have gotten busted.

Sounds like you guys aren't smart enough for college.
Underage. Drinking beer in a public place. Baggie with drug residue.
WTF were the two of you thinking?

He should lie on that form. They won't do a background check to verify his answer.

Knowing the hash laws isn't going to help your friend one iota. Just ask the DA.
What WILL help him is a lawyer. Get him to court very early with $500 in hand. Ask around to see if one of the lawyers that's in court that day would be willing to take your case. Pay them--THAT will help your friend A LOT.
You really have your back to the wall here. When did this happen? Didn't your friend have time to shop for a lawyer before his court date?
Why do people not hustle to get a lawyer when they get into trouble; or, better still, shop for one beforehand if they're going to partake in illegal activity? They're at the mercy of the court!
EDIT: This post was from yesterday, so my advice is a day late and a dollar short anyway. For posterity, I'll leave my good advice in, but I'll switch my comment to:
-------------------- "Inspiration ~ Move me brightly ~ light the song with sense and color ~ hold away despair ~ more than this I will not ask ~ faced with mysteries dark and vast ~ statements just seem vain at last" --Jerry Garcia, Terrapin Station "Officer, I'm going to remain silent, and I would like to speak with a lawyer. I'm not resisting, but I don't consent to any searches.

Not having a lawyer is a good reason for a continuance, so there's really no reason to rush out and get one.
If you want to delay things you shouldn't have trouble getting at least two continuances to buy some time. 1st one is "haven't had time to find a lawyer" and the 2nd can be "can't afford one yet".
IMHO it's always in your best interest to get a public defender first. Let them do the initial paperwork, discovery, etc.. Stay on their ass, then get a real lawyer if it seems like a good idea. You'll have saved potentially thousands of dollars by letting the PD do a lot of the work. Then your hotshot can come in and just do the argument.

I don't believe it's a "misdemeanor" (a crime) if it is under one ounce, it is a civil offense, like a speeding ticket-- a citation and a fine is what you get.
I would think hash should be considered the same as marijuana.
But if it's just a civil offense, why would you have a court date (unless it was for underage drinking, which would make sense.)
