Cops, Filming, and Evidence

So, the more I learn about the legal system, the more I realize how important it is to gather as much evidence OUTSIDE of the cops as possible.

Basically, when a cop writes the report, he'll write it "by the book." When he's called to the stand for direct examination, he'll state his case as he wrote it, "by the book." In other words, he'll write it as if he followed the legal procedures to the letter of the law. If it's your word against a cop's, you don't really stand a chance.

But... if you have:

1. Eye Witnesses
2. Audio Recordings
3. Video Recordings
4. Digital information
5. Pretty much anything that exists outside of the cops word

That all strengthens your case, because one then gives their defense attorney more to work with; more things to find discrepancies with.

For example, think of a DUI charge.

WHAT THE COP SAID/WROTE: Administered breathalizer according to specified procedure.
WHAT THE COP DID: Stuffed the thing into your mouth without instruction while chatting on the phone with his buddy. Dropped it on the floor, wiped it off with his sleeve, and gave it back to you for the second try.

So, if you have a video of the cop breaking the procedures, your defense attorney can call the breathalizer evidence into question. In the second example:
1. The proper procedure was not followed
2. The radio frequencies from the cellphone call may have interfered with the breathalizer results
3. The drop on the floor may have damaged the equipment.

So how can this be proven? Immediately request a copy of the surveillance video from the breathalizer room.

Moral of the story? Gather everything that you can about a case for your attorney. If any video or audio was recorded, make a request in writing immediately. After the encounter, write it down, exactly as you remember it happened. Get the names and numbers of eye-witnesses. Gather evidence to defend yourself!

And, of course, shut the fuck up until you get a lawyer.
