Let's discuss this. They don't "have to beat the feds first," the law goes into effect on December 6, 2012. From that point on, local officials cannot legally prosecute smokers. This doesn't mean that the feds can't send paramilitary forces to tear down dispensaries, grow co-ops, etc, but the question is "will they?".
I'm more concerned with the "Growing" portion of the respective bills than the development of infrastructure for market marijuana--the ladder will be very easily targeted by the feds. You can imagine that if the state has a few large marijuana production facilities, the federal government will easily swoop down and nip the movement in the bud (so to speak). BUT CO amendment 64 has this provision made expressly legal:

(b) POSSESSING, GROWING, PROCESSING, OR TRANSPORTING NO MORE THAN SIX MARIJUANA PLANTS, WITH THREE OR FEWER BEING MATURE, FLOWERING PLANTS, AND POSSESSION OF THE MARIJUANA PRODUCED BY THE PLANTS ON THE PREMISES WHERE THE PLANTS WERE GROWN, PROVIDED THAT THE GROWING TAKES PLACE IN AN ENCLOSED, LOCKED SPACE, IS NOT CONDUCTED OPENLY OR PUBLICLY, AND IS NOT MADE AVAILABLE FOR SALE.
It doesn't seem that you need any sort of license to grow in your own home. This democratizes marijuana production which can be in the hands of individuals or co-ops, instead of corporations. Also, I expect that this provision also goes into effect on the 6th of December, meaning that people will be growing marijuana legally as early as next month. How can the feds stop that? Not efficiently, surely. Additionally, this makes Colorado the marijuana hub for distribution. Legal weed will be exported as illegal weed in cars traveling out of state more than they are now, as the product will be easy to obtain.
If the movement gets off the ground in these states, it will only propagate itself to further areas.

The feds do not have the resources to target anybody but the highest of high-profile figures. For a guy growing 6 pot plants in his house or garden, I doubt he will have anything at all to worry about. Almost all marijuana-related arrests are done so on the state and local levels. The feds can fight it, but it's only becoming more and more futile as more states allow medical and now recreational marijuana. Their resources are not growing like the sources of legal pot are. I really think that this is the beginning of the end for marijuana prohibition.

Yeah, the feds in washington already busted several medical marijuana throughout the years, it wasn't much though and typically the larger grows. This'll give me time to get some funds so I can start a fully large scale pot farm, with some advanced aquaculture going on, then after that score some contracts with some sellers, and maybe even clothing manufacturers, paper makers whatever pot can be made out of.

I am happy to see this happening in my state (WA) but I am skeptical as to how long it will last. That said, if it is here to stay I am concerned as to how employers will handle the issue.
I can understand not wanting employees high or drunk at work, but let's say I haven't smoked for a month and then test positive for cannabis. I'm not high at work but will I be subject to being treated as if I were?
Is there a test to determine if an employee is high NOW as opposed to having been high a few weeks ago, or even a few days ago for that matter?
I would love to hear theories as to how this might be handled fairly, or do you think employers will (like the federal gov't) not recognize the legality of cannabis on ANY level?

It changes nothing. Employers can choose not to hire you for using legal substances...They can fire you for using alcohol or smoking...
I don't see a lot of employers suddenly changing their drug testing policies because of this.

I do, though I doubt it will be suddenly. The disqualifying drugs are pretty arbitrary anyways- most employers I've worked for don't even have a policy on what drugs are diqualifying, just whatever the lab reports they'll refuse hiring for.
A number of my friends switched over to opioids from marijuana when they were put on probation as kids. That alwyas works out well

So what happens to all those people doing time for weed offense's or fines. So Dec 6 out of jail??

Not many people are "in jail" for possession of under an ounce of marijuana--the imposed legal limit. Anyone under that amount usually just gets fined, why waste the money throwing a small-time toker in jail? Those in jail for pot are probably in for having carfuls searched/seized.

Does anyone know how they are going to proceed with DUI's for marijuana? I thought I read something that instead of testing for THC which staying in your system for weeks, they will test for a different substance that comes from smoking marijuana that is only in your system for hours to days. Anyone confirm/disprove this or shed light on other knowledge about the subject?
