This is what companies do- blame the stupid laws. A company has to defend their trademarks or at least make the attempt to show that they are trying to defend their trade marks or they can potentially lose them. I've seen the same thing happen in the beer world where a brewery sent a c and d to a homebreweing store that sold a clone kit for one of their beers. The name was too close and they had to change it.
Believe me, these companies would rather not fork over piles of cash to blood sucking lawyers. There are just miles and miles of rules and regulations in this country so they have no choice.
On the chicken front: I don't think this was the wisest battle for the gay community to choose and the saber rattling by the liberal mayors is backfiring. If they really want to change things in society then how about the work on a positive message?
It is always better to be positive and constructive then negative and destructive. It is always better to be "for" something than "against" something. I have an idea: how about a few organizations representing the "gay community" reach an olive branch to chic fil'a's charity and work together on something they both can agree on. Anything from building habitats for humanity to feeding the homeless.
Glitter attacks, flash mobs, "kiss-ins", and general disruption of a business really rubs the general population in the wrong way. Especially when it is over something covered by the first amendment.

I will never waste any money on their shitty product. And its funny because I was in Walgreens looking for Tea one day and I saw their product. I decided that I could find better and just kept walking

i don't think whether or not a name is close means it is copyright infringement. there are plenty of "similar names" out there for products that are practically identical... look and e-cig juices: there's "nuport" "palmall" "winson""marbow" yada... http://www.aromaejuice.com/E-Juice-E-Liquid_c18.htm

no one fucking cares how close the name is, its not the same name and thats all that matters.

That is, until the Mom & Pop sue the big company first. Or if the big company knows about it and chooses to let it slide, then the mom & pop shop gets bigger and starts expanding, the trademark infringement becomes an issue. When the big company sues, the M&P shop will say that the big company knew of the product and didn't sue when they found out. It weakens their case. Or, it gives other small mom and pop shops everywhere free reign to copy the products as well.
It might seem like bullying, but it could snowball into something really bad for the big company if they just choose to ignore it. But hey, it's Shroomery, knee-jerk reactions are all we do here so scratch everything I just said:

Usually the lawyers will send out a 'Cease and Desist' order before filling a lawsuit. It's much cheaper to do it that way.

I looked through the lists of herbal teas on both company websites and I can't see much similarity between most of the names. Humboldt has an "Orange Spice" and CS has a "Mandarin Orange Spice", I guess those are pretty similar. There seem to be several tea companies that offer teas with similar names though, e.g. Bigelow has an "Orange & Spice". I guess it's hard to really make a judgement whether there's any merit to their complaint without knowing which specific names they're saying are similar.

I think suing over a very common-place name like "orange and spice" is almost the height of litigious ridiculousness.
It brings up an interesting question about copyright/trademark law.
I could see if the name was "Ultra Orange Spice" and the knockoff was "Mega Orange Spice".... that would be CLOSE. But when the product is tea, and the name of the tea merely reflects the primary flavoring ingredients?
