first off my criminal record: m.i.p. tobacco 2004 m.i.p. alcohol 2x 2005-06 possession of stolen property 3rd degree 2006 retail fraud 3rd degree 2007 failure to yield (traffic ticket) 2010 driving while license suspended march 2012. judge said i had 45 day delayed sentence.
2 days ago i got pulled over for my 2nd d.w.l.s. i bonded out right away. im 25yrs old with a full time job. i live in a very rural area.
i know it could be fines and/or up to 1yr in county. just curious if any of you guys have been in a similar situation and what your sentence was?

you probably need an attorney, you will look like you care and have a plan. Call some attorneys up and say you have a reliable job. You do not want to be in jail

should i pay for an attorney or get a court appointed? my boss is going to write a letter for the judge explaining how he needs me to be able to work and just to vouch for me i guess. not sure if it will help but it cant hurt. would it be possible to take probation or tether over jail? up to the judge im guessing. thanks for the advice guys.
i had open campus in high school so i would walk down the road to have a smoke. it was the school cop who caught me. thats pretty much all he did was drive around looking for minors smoking. he acted like he caught osama bin laden when he caught me smoking too. i seriously think he got off.and yes he was the biggest dickhead of a cop Ive dealt with to this day.

Do you have the option of court appointed in your state? Some states don't have pd for misdemeanors..others do.

If it comes down to t request work release. I did it for 3 months. You have no violent charges so I don't see why they would turn you down, especially with a letter from the boss.

eh work release isnt really an option. the jail is 45miles from my employment and i dont know anyone that would come pick me up and drop me off everyday. i guess i could offer em my paycheck. it would suck workin for free but better than being in jail 24/7.

You don't drive? I drove myself in work release. It would be a lot of driving but better than loosing your job

Here is a thought.
Why don't you learn to just obey the rules.
Think about how much time you spend worrying about what is going to happen to you.
Think about how living in this state is very unhealthy for your mind.
Rather you go to jail or not should be the least of your worries, you should be thinking more about how you can adjust your life so that you are not in these situations.

the reason for me not wanting to go to jail is so i can keep my job and continue trying to improve my life. the only reason for me driving was back and forth to work. i do agree the stress from this shit has a big impact on me. i am trying to live a better lifestyle. i think i have come a long way from who i used to be. going to jail and losing my job would be a huge setback.
my first dwls was march 2012

Have you settled the first DWI? If you get a good lawyer you can probably avoid jail time if you admit you have an alcohol problem and go through intensive rehab before your court date. How much money do you have? If it isn't a lot, I'm sure you're going to spend it all on a lawyer to get that deal for you though, so it is only worth it if you stop being a drunken fuckup.

it was a driving while license suspended not intoxicated. yes the first one is all taken care of. fuck up yes. a drunk not even close.

sorry if I come off a bit harsh....but....life is whole lot easier if you choose wisely your battles.
Don't do the crime if you can't to the time.
The only thing in life that really can hurt you is your own fear. Some folks find the food in jail pretty tasty!

I thought that said D.W.I what is a dwls? Nobody goes to jail for driving while suspended, but your car is definitely marked and you should stop driving.

well i kind of got some good news today, a coworker agreed to pick me up and drop me off at the jail for $200.00 a week if i get jail with work release. what a weight off my shoulders! knowing im not going to lose my job if i go to jail. is there any reason why the judge wouldnt grant me work release?
what state do you live in? i have been arrested twice now for driving on a suspended license. im for sure done driving. a 3rd strike would be felony.

I'm from Minnesota and I know a girl who has like 14 driving while suspended. They're all misdemeanors, but they aren't going to throw her in jail for any serious time.

Dude why in the hell would you not have had someone from your job just pick you up for work in the first place?
Just be happy you didn't get into an accident and hurt somebody because you would have been totally fucked.
So let me get this right. You are willing to pay someone 200 dollars to pick you up from work release but not willing to do the same on a 45 day suspension?

in denver you'd be in jail automatically because it is a second DUI/DWAI offense
also stop driving intoxicated

Well at least you still know what I'm talking about. So i misspelled a word, whoopee doo. There's at least three people in this thread, that didn't even read, or don't understand what this guys asking.
To OP, since no one else has given you a real answer I will. Honestly, the judge already gave you a break by giving you a delayed sentence and not throwing your ass in jail for the first offense.
Judges don't take it well when you blatantly throw it back in their face like you don't give a fuck. So you may very well be ending up serving that 45 days. Regardless of whether or not you get a lawyer or have letters from your employer, he's not gonna give a shit. He already gave you the benefit of the doubt.
A judge doesn't give a shit if you need to get to work. That's your problem and you lost your PRIVILEGE to drive due to the consequences of your own actions. Like I said before if you have friends or your employer who likes you that much you should have carpooled to work or something.
If your not prepared to take responsibility for your actions and deal with the consequences then don't break the law. Its a pretty easy concept to understand. The best advice I could give to you, is to explain to the judge why you were doing what you were doing, and pray he doesn't break it off in your ass.
I wouldn't bother with an attorney, he probably cant do much for you anyway since your a repeat offender and the money you spend on him you could use for your work release program.
That's just my two cents. In my younger years I had to serve a two year suspension to have my record expunged of the incident. My friends told me I was stupid because I could have just lost it for six months. But I didn't want it on my record and effecting my employment opportunities later down the line.
So basically I sucked it up did the time and went on about my business. I hold a great position in a company now. I would have not been able to obtain this position if I would have had that charge on my record.
It's OK to live in the now, but you also need to think of your future. Stop doing stupid shit. People always think they are smarter then everyone else and then, when they get their Pee Pee smacked, are like what the fuck?

i just remembered about this thread and thought i would follow up with what happened. on the court date that i was referring to above i plead not guilty and asked for a court appointed attorney. a month later i had a pre-trial conference and the pa offered a plea deal that if i plead guilty they will drop it to first offense with no jail time. which i thought was a pretty sweet deal. all in all just $400 in court fines $200 attorney fees and a couple missed days of work. i definitely learned my lesson from this whole ordeal, i even parked my car at my mas place so i cant drive.

I didn't know u went to jail for driving with a suspended license. It's happened to me a couple of times, as well as my GF. They impounded my car, but never arrested me.
