"Regulate Psychedelics Like Driving": A concrete proposal for legalization of psychedelics * 1

One strategy in the quest to end the disastrous War on Drugs has been to draw analogies between drugs and other things that our society tolerates and regulates.  For example, Colorado has the "Regulate Cannabis Like Alcohol" Act coming up as a referendum in November 2012.  Considering that this act appears to have good chances of passing, it would appear that this strategy of drawing analogies is working.  We should, therefore, consider extending this strategy more broadly to the benefit of ending Prohibition and the War on Drugs more widely. 

However, whereas American society is increasingly accepting the analogy between marijuana and alcohol as two relatively safe intoxicants that can occasionally be abused, American society remains much more skeptical of the potential to use psychedelic drugs safely in any manner whatsoever.  Users of psychedelic drugs will typically judge psychedelics much more positively, often to the extent of conceiving of the full legalization of psychedelic drugs as a worthwhile goal. 

This proposal, being a political document, will attempt to find a concrete compromise between these two camps.  This proposal does not seek to invalidate more wide-sweeping proposals of full legalization; it merely proposes a workable compromise, situated in the present societal context, that will benefit users of psychedelics and the general public alike in comparison to the status quo of an endless, counter-productive, and brutal Prohibition.

So, shroomery members, I can already anticipate how many of you are going to respond critically to this from the standpoint of this proposal ceding too much personal freedom to the government.  I have considered this objection in advance, and in spite of that objection, my proposal stands, as I think that the government interference in the world of psychedelics as specified in this proposal would be much preferable to the type of government interference in the world of psychedelics that currently reigns supreme.

Note:  While I have tried to be as thorough and explicit as possible, it is guaranteed that there are portions of this proposal that are not written in perfect "legalese."  Therefore, if anyone would like to edit this proposal towards that end, I would greatly encourage it.

Also note:  This proposal is broken up into two Acts:  an act that addresses the federal government's jurisdiction, and an act that addresses the state governments' jurisdictions. 

Act #1:  The Federal "Regulate Psychedelics Like Driving" Act

I.  Definitions.

In this section, for clarity's sake, substances will sometimes be followed in parentheses by a more common name for the substance.

1.  In the following Act, "psychedelics" shall be defined as including the following substances and all their esters and salts, as well as all objects and foods containing the following substances and/or their esters and salts:

A.  The following tryptamines :  N,N,dimethyltryptamine (DMT), 5-methoxy-N,N,dimethyltryptamine (5-MeO-DMT, 5-hydroxy-N,N,dimethyltryptamine (bufotenin), 4-hydroxy-N,N,dimethyltryptamine (psilocin), 4-phosphoroloxy-N,N,dimethyltryptamine (psilocybin), 4-acetoxy-N,N,dimethyltryptamine, 4-hydroxy-N-methyl-N-ethyl-tryptamine, 4-hydroxy-N-methyl-N-isopropyl-tryptamine, N,N,di-isopropyl-tryptamine, 4-hydroxy-N,N,di-isopropyl-tryptamine, N,N,dipropyltryptamine, 4-hydroxy-N,N,dipropyltryptamine, 5-methoxy-N,N,dipropyltryptamine

II.  Regulations.

1.  Modifications to the Controlled Substances Act of 1970. 

The Controlled Substances Act of 1970 is to be modified in the following way:

A.  Psychedelics, if currently specified under a schedule in the Controlled Substances Act of 1970, are to be de-scheduled.

II.  Regulations. 

1.  The Government of the State of _________ shall create a Department of Psychedelic Licensing.  This Department shall administer the psychedelic licensing for the state, which shall consist of:

A.  Creating written tests. 

Written tests shall be designed for each classification level (see below) with the aim of determining that the applicant has the knowledge and judgment to use that particular classification level's allowed substances responsibly. 

B.  Administering written tests. 

C.  Licensing psychologists. 

Psychologists shall be able to apply to the Department of Psychedelic Licensing for certification.  Upon being approved, such psychologists will be able to administer the requisite psychological screenings for each level. 

D.  Administering local offices for the Department of Psychedelic Licensing.

Local offices shall issue psychedelic licenses to those applicants who meet the qualifications specified below. 

2.  Psychedelic license classifications

Three psychedelic license classifications shall be created:

A.  Class A

i.  Requirements.

a.  The individual must be at least 21 years of age.
b.  The individual is required to have passed a Class A psychedelics license written exam.
c.  The individual is required to have been screened and approved by a licensed psychologist.  The psychologist may only withhold Class A approval if the individual has a situation and/or an attribute(s) that make him/her particularly, abnormally, and severely at-risk for physically harming him/herself or others as a consequence of ingesting the allowed Class A psychedelics. 

ii.  Scope of Class A certification

Class A certification allows its possessor to produce, purchase, sell, possess, and consume all drugs defined as "psychedelics," EXCEPT for those drugs defined as "research chemicals" (including "research chemicals with significant physiological risk). 

B.  Class B

i.  Requirements.

a.  The individual must be at least 25 years of age.
b.  The individual must have possessed a Class A psychedelics license for at least 3 years. 
c.  The individual is required to have passed a Class B psychedelics license written exam.
d.  The individual is required to have been screened and approved by a licensed psychologist.  The psychologist may only withhold Class B approval if the individual has a situation and/or an attribute(s) that make him/her particularly at-risk for physically harming him/herself or others as a consequence of ingesting the allowed Class B psychedelics.

ii.  Scope of Class B certification

Class B certification allows its possessor to produce, purchase, sell, possess, and consume all drugs defined as "psychedelics," EXCEPT for those drugs defined as "research chemicals with significant physiological risk." 

C.  Class C

i.  Requirements.

a.  The individual must be at least 25 years of age.
b.  The individual must have possessed a Class A psychedelics license for at least 3 years. 
c.  The individual is required to have passed a Class C psychedelics license written exam.

III.  Penalties.

Note that these penalties add separately to possible additional penalties resulting from transgressing possible additional state or federal laws against forging identity documents and/or operating motor vehicles while under the influence and/or reckless endangerment and/or disturbing the peace and/or any other crimes specified by state or federal law. 

1.  Providing licensed psychedelics to an individual lacking the proper certification.

Providing a licensed psychedelic substance to an individual without the proper classification shall be a misdemeanor offense. 

2.  Possessing a fake license card. 

Possessing a fake license card shall be a misdemeanor punishable by up to a $500 fine. 

3.  Manufacturing a fake license card. 

Manufacturing a fake license card shall be a misdemeanor punishable by up to one year in prison and/or a fine of up to $1,000. 

4.  Possessing licensed psychedelics without proper certification. 

Possessing licensed psychedelics without proper certification shall be a civil misconduct punishable by confiscation of the material and a fine of up to $100. 

5.  Selling or otherwise providing licensed psychedelics without proper certification. 

Selling or otherwise providing licensed psychedelics without oneself possessing proper certification shall be a misdemeanor punishable by up to one year in prison and/or a fine of up to $1,000.

A very interesting write-up you have here.

I tend to lean against licensing, but this doesn't strike me as too bad of an implementation. It allows for punishments for violating licensing, but they are pretty reasonable.

I would definitely support some sort of tax program to tax psychedelics, and possibly use that money to subsidize licensing fees/psychologist assessments. I don't think people should be turned away for being unable to pay for a license, so taxing the sale of psychedelics seems like a reasonable way to pay for the regulatory costs.

First of all, I love this idea. But honestly your punishments are way too low, seriously u have it a misdameanor to manufacture and sell wihtout proper license... Till i got to the punishment section I really loved your work. The punishment section should be all felonys starting with a D and going to a B...


Also your licenses should only allow people to posses and sell. No way should general public be able to manufacture there own psychs, this is just a crazy idea to me as you would have different potency stuff at every gas station and accidental over ingestion would greatly increase.

If your going to give people great responsiblity of legaly possessiong and selling phsychedelics then there needs to be extremely stiff laws to prevent people from skirting around the assesments. Right now you have it a fine to make a fake phsychedelic card, well hell its more of a crime to make a fake ID then you have to make a fake pshych card? Honestly manufactureing physchedelics without a license should carry the same penalties under your act and it does under the current law.       

I really love what you have started here, I would like to expand on it. I know you probably got to the punishment section and wanted to go light to get shrommery support. But if this were ever to really happen  I think you would need very stiff laws to get people who wouldnt every pshychson board with this.

I too am a fan of the idea but also think the punishments are too lenient. Still, I don't think that anything regarding licensed psychedelics should be a felony crime unless your distribution to a person causes physical harm to them.

To me it seems that making the manufacturing of psychedelics by normal citizens completely illegal would just throw the system into corporate or pharmaceutical greed, with an equally greed run underground. Think moonshine but with people tripping balls :laugh: I think that (nonexpert) people should be able to manufacture a psychedelic product without prosecution, but not be able to sell it without license. This way people could have their own shroom and mescaline grow, or their own DMT and MDMA extraction setup, they just couldn't distribute their product to others without receiving the proper licensing. This would prevent corporate takeover of the industry.

On a side note, I really enjoy the OP's inclusiveness of RCs, and requiring a higher class of licensing to use them. It would completely defeat the purpose of the entire system not to include gray market drugs, and would just end up pushing a bunch of sketchy chemicals onto the youth, just like what's happening today! :tongue2:
