Rittenhouse is screwed, he is a minor who armed himself to take the law into his own hands!!! He has no reasonable defense, because he should never have armed himself in the first place to attend a protest, vigilante justice is against everything this nation stands for, that's why we have police!!! I can only hope that dumb sumbitch who went with Rittenhouse is charged as an accessory to murder, child endangerment, arming a minor with the intent of vigilante justice and any other charges that they can think of. I don't understand why anyone thinks his actions were justified, he wouldn't be in this situation if he would have never armed himself to play police.

So in the event of an open carry protest, if violence breaks out and a minor uses a fire arm, what is the situation? Cause I see him getting convicted of some weird federal offense
I think Rittenhouse is a tragic character. Even in prison I doubt he'll get enough alone time to think about what he did. He is too young to even have thought completely enough about the politics of the day not to mention the mechanism of firearms. Although that was a sweet clear under pressure. Doesn't change the fact he also shot with no care about what's behind his targe with a high caliber rifle. I have a .308. I have already decided there are too many kids in my neighborhood to use it in self defense as the houses are super close together.

I don't mind hypotheticals or questions regarding current events. When the thread turns into a debate, people's questions get lost in the mix, however.

Enlil, I have a two part question with the first concerning bias. I'm following the Rittenhouse trial and it seems like the judge is biased towards the defense, will the prosecution be able to use that to retry the case, if they can prove the judge is biased or do they have to request the judge be removed before the trial is over?
#2 Can Kyle be charged with other crimes relating to his actions during the protest, if aquitted on the current charges? I know he can't be charged with homicide again, because of double jeopardy, but what about manslaughter or lesser charges?

I'm not following the trial, other then the memes going around about how the prosecution is fucking up, in regards to putting the dude who got shot on the stand, and then bringing up suppressed evidence. What biases are you seeing, cause the media isn't even saying that and I don't feel like watching the whole thing.

I use the word "seems" because I'm not sure if that's what I'm actually observing. I get the impression that the judge has been leaning towards the defense from the beginning, because it my impression that he's giving the defense a little more lee way, would be the best way for me to describe it. I'm not an expert on court room proceedings, so it's possible that the prosecution is acting inappropriately, I don't know. If bias is perceived by either side, is there a rule for when to address it? Particularly, when it's related to the judge.

I kinda watched some of Kyle's testimony. Maybe cause of the past two days, but yea I could see how the judge was a bit hostile/dismissive of the prosecution. But like idk, the prosecution isn't exactly doing a good job with what they have. They're giving off the vibe of a roommate trying to convince you of something they found on the internet. Idk, I see him getting off on the homicide charges, unless there is some weird shit like if you're with someone during the commission of a felony and a cop shoots and kills them, you're charged with murder.

Proving bias would be very close to impossible, and I doubt any prosecutor is going to go down that road under these circumstances. Either way, they have to prove that the judge made some error that changed the outcome as a result of the bias. That's hard to do.Quote:

Anything that would be considered a "lesser included offense" such as manslaughter would still be barred by the doctrine of double jeopardy. Any offense unrelated to the killing could possibly be brought. I'm not following the case, so I don't know what has or hasn't been charged here.
