Could. If the cops DO show up for him, and smell weed... or see a bong...

But as Enlil said... unlikely.

That's my primary concern. This guy is a fucking moron and smokes in our front room all the time. You and Enlil pretty much re-affirmed what I thought.. going to have a long chat with this guy about getting this fixed and let him know he needs to find another place to live if he brings any heat to our door.

That sounds like closing the barn door after the cows escaped. It might be best to solve the problem before it becomes a problem.

It's unlikely that they would go to his house to do that

Down here the cops have a "roundup" once in a while where they assign a group of them to spend a week just going to the last known address of a stack of long-standing arrest warrants. They're fishing, but since they knock on a lot of doors, they always catch something.

I've had friends snagged by this. They usually show up early, like 5am, and pound on the door like the place is on fire. It disorients the people inside into opening the door.

Me? I don't acknowledge knocks on the door at all unless I'm expecting someone. And even then, if I saw police through the peep, I would just go back to whatever I was doing and ignore them. If they see me through the window, I'll sit on my couch, show them my hands, and tell them to bust down the door if they have a warrant or fuck off if they don't. Not one single syllable more than that.

Oh, something else they've done here is send a postcard to the address telling the person on the warrant that Walmart (or some other store) had a contest and they won a TV. They'll need to bring the post card and a photo ID to their warehouse on Friday between 8am and 6pm to pick up the prize. Bring a large car or truck as this is a 60 inch plasma screen and they'll need the room. Wink wink.

Guess what happens when they arrive. Hint: they don't get the TV.

They do that for traffic warrants?  That's a department with way too much time on their hands.

Yep.

They take the whole set of warrants, including bench warrants for traffic issues. It's casting a wide net to catch whatever they can. Failing to appear for a traffic case resulting in a bench warrant can eventually result in two cops pounding on your door LOUDLY at 4am.

That can and *will* happen out here, but only if the police know something's going on and need an excuse.

Town of 300 people, the worst thing that really goes on is a cop has to drive someone home that's too drunk to walk.

South Florida has about 6 million residents between Miami and Fort Lauderdale and Palm Beach. The Miami PD at one point had close to a million warrants outstanding. :whoa:

No wonder the US is the only nation on Earth that has fully one percent of its population in prison, many of them for having an illegal plant in their pocket. :nonono:

Absolutely. Your advice is noted and appreciated, along with everyone else thus far. This guy has been an issue on other things, but his name is on the lease. It will be made clear that if he refuses to solve this problem and continues to spend money that should otherwise go towards a lawyer/fines on pot and booze, then he will need to find a new place to live once the lease is up.

The original creditor sold the debt.  They can't accept payment if they wanted to.  In addition, it's unlikely that they're going to make such a deal even if they still owned the debt.  That was pretty common 10 years ago, but few creditors agree to that anymore.

Option 3 is the one that does the least damage to you.

1 results in immediate cost to you plus a good chance of paying $5400 or getting a judgment for more than that against you
2 results in a guaranteed judgment plus years of dodging and ducking
4, as mentioned above is probably not even an option.

You played chicken with the plaintiff...they haven't flinched...Is it really worth running off of the cliff on principle?

Just to close the loop on this I got them down to $4400 and paid em today. They said that they're going to send something called a "Stipulation Letter" (whatever the hell that means) to the court.

Anyway, thanks for the advice Enlil. Talk about a single move that simplifies my life: no more court date, trial, lawsuit, calling out of work, etc..

Man, If I knew you personally I'd definitely smoke you up for this.  :jah:

Just to save enlil fielding this one: Stipulation (n) - demand or specify (a requirement), typically as part of a bargain or agreement.

In the legal field it just means they're formally stating the requirements of the deal to the court.

Diploid, you are so fucking spot on. They did a "sweep roundup" and busted a friend of mines grow because he went to take out the trash as they were coming up to his house at midnight...wtf? They said his breath smelled like pot and they threw him in the back of the cop car. Since his door was unlocked they let themselves in and " smelled marijuana smoke". Busted him on his grow in his back room. He's so fucked. It was a bench warrant for unpaid DUI fines.

That's almost certainly a bad search unless they had a separate warrant to search the house.

Anybody who's growing or selling really needs to check their fuckin speeding tickets and DUI records.

It seems every third or fourth story involves something as simple as showing up to pay $100 - or in some cases can be done online - and then a person gets snagged.

C'mon now guys, really?

And no jush, not aimed at your buddy specifically, it's alarming how many are even posted in the News Forum.

His attorney tol him that of the five judges possible there is only one who is even considerate of throwing out a case in spite of evidence they've uncovered. They let him plead down to "attempt to manufacture a controlled substance" which hopefully removed actual jail time to a 3-5 suspended sentence with 3-5 years of probation. Sloppiest police work I've seen.

Did the cops lie and say that he let them in or something?

I've heard second-hand (don't know personally) of cases where the cops knock on the door and the resident does the standard advice we always hear of opening the door, walking out on the porch, then closing the door behind them. But when they tried to close the door behind them, one cop would push the resident out of the way while the other barges inside.

Later in court they simply lie and say they got consent. I'll give you one guess who the judge believes.

That's why I ignore cops at the door entirely. And if they see me, I'll show my hands so they don't have reason to shoot me and wait for them to bust down the door or go away. There's is NO WAY I am opening the door.

No, they said they smelled marijuana and just pushed past him. The door was unlocked. They never called in backup, and a good deal of evidence was never checked in. Someone had an excellent fourth of july.

They said he let them in, then they smelled marijuana which gave them probable cause....fuckers.
Fuckin cops....sheriffs....whatever.

You've changed the story significantly...before, he was in the cop car and they searched the house...now you're saying he was at the door and they pushed past him.

Details matter.

There were two sheriffs rounding the corner of his house. They immediately detain him as one sheriff rifles through his pockets and grabs his keys/puts him in the cruiser the other sheriff is trying the knob.
